<br />certain as may be agreed upon by the City, and further agreeing to hold the
<br />City, its agents, officers and employees free and harmless from all claims
<br />of any nature whatsoever arising in any way out of applicant's use and
<br />occupancy or the condition of said property, and further agreeing to furnish
<br />the City a performance and completion bond or cash bond or other acceptable
<br />security in an amount and form deemed adequate by the City Engineer, securing
<br />the performance of said contract. Said agreement shall be in a form approved
<br />by the City Attorney.
<br />(C) In all cases, deed or cause to be deeded all right-of-way, and
<br />easements in accordance with any street plans, Specific Plan, or General Plan
<br />of the City or as may be required by the City Council of the City of Colton.
<br />(D) In computing said 400 square feet as aforesaid, the same shall
<br />be cumulative on two or more enclosed structures, remodelings, or additions
<br />when there is the same owner and the second or more enclosed structures, re-
<br />modelings, or additions occur within a period of five years.
<br />SECTION SIX. That all ordinances or parts of ordinances, in conflict
<br />with the terms and provisions hereof, and particularly, but without limitation,
<br />Ordinances Number 1579, 1593, 1601, and 1612 are here repealed.
<br />SECTION SEVEN. If any section, subsection, sentence, clause or
<br />phrase of this Ordinance is for any reason held to be unconstitutional, such
<br />decision shall not affect the validity of the remaining portions of this
<br />ordinance. The City Council of this City hereby declares that it would
<br />have adopted this Ordinance and each section, subjection, sentence, clause,
<br />phrase or portion thereof, irrespective of the fact that any one or more
<br />sections, subsections, clauses, phrases or portions thereof be declared
<br />invalid or unconstituional.
<br />SECTION EIGHT. It shall be unlawful for any person, firm, or
<br />corporation to erect, construct, enlarge, alter, repair, move, improve, remove,
<br />convert, or demolish, equip, use, occupy, or maintain any building or
