(Provided, however, where the prior ten- <br />ant has been paying rent based on special consessions not ex- <br />tended to all other tenants on the same basis, e.g. inability to <br />pay, personal relationships, etc., the owner may adjust the rent <br />upward so that the new tenant is paying rent which is no more <br />than that paid by other tenants enjoying the same or similar <br />accommodations and benefits.) If a park is exempt pursuant to the <br />provisions of Section 1.03B of this Chpater, the provisions of <br />any parkwide rental agreement apply to any new tenant for the <br />duration of the agreement. <br />D. Refusal Of Tenant To Pay Illegal Rent - A tenant <br />may refuse to pay any rent in excess of the maximum lawful rent <br />permitted by this Chapter. The fact that such unpaid rent is in <br />excess of the maximum lawful rent shall be a defense in any <br />action brought to recover possession of a mobile home space for <br />nonpayment of rent or to collect the illegal rent. Collection of <br />any amount in excess of the maximum lawful rent as prescribed <br />by this Section shall constitute a violation of this Chapter <br />and shall be punishable as set forth in Section 1.10. <br />E. Posting and Notice of Rent Stabilization <br />Ordinance - The City shall send a copy of the provisions of <br />this Chapter as from time to time amended to all owners who are <br />subject to its provisions. All owners shall permanently post <br />a copy of this Chapter together with any amendments in the park <br />office or other conspicuous spot. Owners shall notify any <br />15 <br />
