1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />determined that it is necessary to extend the moratorium and to modify its terms in accord with <br />the provisions of Government Code Section 65858. <br />NOW THEREFORE, THE CITY COUNCIL ORDAINS AS FOLLOWS: <br />SECTION 1: The City Council finds and determines the following: <br />(a) The potential for improperly compacted building sites in the slope areas of the City <br />primarily located in the Reche Canyon and immediately adjacent hillside areas exists as <br />demonstrated by recent problems in construction appearing in that area. <br />(b) In order to address this problem, the City must conduct a review of its policies <br />and procedures to assure that adequate safeguards are in place to reasonably assure <br />quality construction of new buildings in slope areas for the protection of the health and <br />safety of Colton residents. <br />(c) It is anticipated that the necessary review will take longer than the initial 45 days <br />during which this moratorium was originally to be in effect. <br />(d) Pending the outcome of the review and modification of any building standards or <br />procedures that may result from that review, including without limitation amendment of <br />City Code provisions relating to compaction, it is necessary to impose a moratorium on <br />the issuance of building permits for any new construction or for rehabilitation of existing <br />construction in the Reche Canyon slope areas as identified by the Community <br />Development Director as high risk areas. <br />-2- <br />
