1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, in order to accomplish the turnover of waste collection, removal and <br />disposal to Taormina pursuant to the terms of the Contract, it is now necessary to amend the <br />Colton Municipal Code to conform with the provisions of the Contract; and <br />WHEREAS, the City Council finds and determines that an emergency situation exists <br />necessitating the immediate and urgent implementation of an immediately effective ordinance <br />under the provisions of Government Code Section 36934 amending certain sections of Chapter <br />6.16 of the Colton Municipal Code to assure consistency of the Contract and applicable law in <br />order to protect the health, safety and general welfare of the city. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1: Section 6.16.025 of Chapter 6.16 of the Colton Municipal Code is hereby amended <br />to read in its entirety as follows: <br />"Expansion of refuse collection services. Effective July 1, 1996, prior to <br />expanding any collection, removal or disposal service within the city, any person <br />authorized to collect, remove or dispose of refuse within the city shall request and <br />obtain approval from the city council for modification of the terms of any permit, <br />franchise agreement or contract in effect in order to allow the requested expansion <br />of its existing authorized service area. Nothing in this section shall prevent the <br />city from contracting and/or issuing a franchise or permit for the collection, <br />removal or disposal of refuse within the city on such terms and conditions as the <br />2 <br />
