1 SECTION 6: PUBLIC HEARINGS <br />2 Hearings conducted by the Civil Service Board shall be public, unless the Board shall determine that a <br />3 private hearing is necessary to secure all the facts in the case. Whenever such a finding is made, the <br />4 Board may limit attendance at the hearing to the members of the Board, officers from whose action the <br />5 appeal was taken, and such witnesses and other persons as the Board may require to be present. The <br />6 hearing need not be conducted according to technical rules relating to evidence and witnesses. (Moved <br />7 from Resolution 2240, Rule III, Section 2) <br />8 <br />9 SECTION 7: DUTIES OF THE CIVIL SERVICE BOARD (Ordinance 1122, 1962) <br />10 The Civil Service Board shall determine the order of business for the conduct of its meetings, and shall <br />11 meet on call of the chairman or four members of the Board. Four members of the Board shall constitute a <br />12 quorum for the transaction of business. (Quorum minimum Amended by 0-03-93) <br />13 <br />14 The function of the Board shall be: <br />15 a. As provided by this ordinance and by the rules, to hear appeals submitted by any person in <br />16 the competitive service relative to any disciplinary action, dismissal, demotion, or alleged <br />17 violation of this ordinance or the personnel rules and to certify its fmdings and <br />18 recommendations as provided in this ordinance. <br />19 b. In any investigation or hearing conducted by the Board, it shall have the power to examine <br />20 <br />witnesses under oath and compel their attendance or production of evidence by subpoenas <br />21 issued in the name of the city and attested by the City Clerk. It shall be the duty of the <br />22 Police Chief to cause all such subpoenas to be served and refusal of a person to attend or to <br />23 <br />testify in answer to such a subpoena shall subject the person to prosecution in the same <br />24 <br />manner set forth by law for failure to appear before the Council in response to a subpoena <br />25 issued by the Council. Each member of the Civil Service Board shall have the power to <br />26 <br />administer oaths to witnesses. <br />27 <br />28 <br />Page 4 of 8 <br />
