When requested by the Council or the City Manager, the Civil Service Board shall hold <br />2 hearings and make recommendations on any matter of personnel administration, within the <br />3 limits of a request of the City Council or the City Manager. <br />4 (See Section 14 regarding violation ofsaid duties) <br />5 <br />6 SECTION 8: REQUEST FOR HEARING (Ordinance 1122, 1962) <br />7 Any permanent, full time employee in the competitive service who has had any disciplinary action, <br />8 dismissal or reduction in pay shall be entitled to request a written statement of the reasons for such action. <br />9 Such a request must be made within three working days following the action, and he shall have three <br />10 additional days within which to answer the charges in writing. In the event the employee requests the <br />11 statement and prepares his written answer, copies of both shall be filed with the City Manager, who shall <br />12 transmit them to the Civil Service Board. Within ten days from the date of filing his answer to the written <br />13 charges, or in the event such written charges have not been made available to him within the time <br />14 prescribed, then within ten days after the action taken to demote, dismiss, or reduce the pay of the <br />15 employee, he may file a written demand with the City Manager requesting a hearing before the Civil <br />16 Service Board. The Civil Service Board shall then investigate the case (by means of <br />17 reports/testimony/merits of the case) and conduct a hearing as provided in this ordinance and by the rules. <br />18 <br />19 The provisions of this section shall not apply to reductions in pay which are a part of a general plan to <br />20 reduce salaries and wages. <br />21 <br />22 SECTION 9: RIGHT OF APPEAL (Ordinance 1122, 1962) <br />23 Any permanent, full-time employee in the competitive service shall have the right to appeal to the Civil <br />24 Service Board relative to any disciplinary action, dismissal, demotion or alleged violation of this <br />25 ordinance or the personnel rules; except in instances where the right of appeal is prohibited by this <br />26 ordinance.
