Based on the entire record before the City Council and all written and 2 oral evidence presented, the City Council finds this Text Amendment is reasonably related to the public welfare of its citizens of the City of Colton 3 and the surrounding region because it promotes and achieve General Plan principles in a manner that does not adversely affect the welfare of the 4 citizens of the City of Colton and the surrounding region. 5 SECTION 2: Section 18.48.120 of the Colton Municipal Code is hereby 6 added to Chapter 18.48 to read as follows: 7 "18.48.120 Parking Vehicles for Certain Purposes Prohibited. 8 A. The City Council of the City of Colton hereby finds and determines as 9 follows: 10 (1) The purpose of this Section is to regulate the circumstances under which persons may park their vehicles in a manner that is not 11 permitted by Title 18. This Section is not intended to restrict any form 12 of advertising that vehicle owners may place on or upon their vehicles. The City Council finds that the regulations imposed by this Section 13 are intended to promote public safety and traffic flow by reducing visual distractions that are likely to cause traffic accidents. Moreover, 14 the restrictions are intended to improve the visual appearance and discourage blighting of properties in the City by eliminating unlicensed 15 vehicles sales on unimproved lots and lots have not been developed 16 with paving, drainage improvements, and other improvements and amenities that are normally required of approved vehicle dealerships. 17 (2) The parking of vehicles on property that is not zoned for such 18 use causes adverse impacts to the residents and businesses in the City of Colton, including but not limited to, the leaking of gasoline and 19 other motor fuels and oils into the ground and groundwater on 20 unimproved properties and properties that have not been developed with sufficient infrastructure to handle such use of property and 21 promoting unfair competition in the sale of vehicles. The regulations will directly advance the City's interests in public safety, efficient traffic 22 flow, aesthetics and economic fairness by prohibiting vehicle sales on properties that are not zoned for such activities and properties that 23 developed the appropriate infrastructure and amenities to safely 24 accommodate such sales. 25 (3) These regulations are reasonably tailored to serve the City's substantial interests in public safety, efficient traffic flow, aesthetics 26 and economic fairness because they do not restrict the ability of any 27 persons to advertise that their vehicle is for sale in lots that are appropriately zoned nor do they restrict the ability of persons to have 28 signs in or on their vehicles advertising the vehicle's availability or other commercial interests.
