1 <br />B. Based on the entire record before the City Council and all written and <br />2 oral evidence presented, the City Council finds this Text Amendment is <br />reasonably related to the public welfare of its citizens of the City of Colton <br />3 and the surrounding region because it promotes and achieve General Plan <br />principles in a manner that does not adversely affect the welfare of the <br />4 citizens of the City of Colton and the surrounding region. <br />5 <br />SECTION 2: Section 18.48.120 of the Colton Municipal Code is hereby <br />6 added to Chapter 18.48 to read as follows: <br />7 "18.48.120 Parking Vehicles for Certain Purposes Prohibited. <br />8 A. The City Council of the City of Colton hereby finds and determines as <br />9 follows: <br />10 (1) The purpose of this Section is to regulate the circumstances <br />under which persons may park their vehicles in a manner that is not <br />11 permitted by Title 18. This Section is not intended to restrict any form <br />12 of advertising that vehicle owners may place on or upon their vehicles. <br />The City Council finds that the regulations imposed by this Section <br />13 are intended to promote public safety and traffic flow by reducing <br />visual distractions that are likely to cause traffic accidents. Moreover, <br />14 the restrictions are intended to improve the visual appearance and <br />discourage blighting of properties in the City by eliminating unlicensed <br />15 vehicles sales on unimproved lots and lots have not been developed <br />16 with paving, drainage improvements, and other improvements and <br />amenities that are normally required of approved vehicle dealerships. <br />17 <br />(2) The parking of vehicles on property that is not zoned for such <br />18 use causes adverse impacts to the residents and businesses in the <br />City of Colton, including but not limited to, the leaking of gasoline and <br />19 other motor fuels and oils into the ground and groundwater on <br />20 unimproved properties and properties that have not been developed <br />with sufficient infrastructure to handle such use of property and <br />21 promoting unfair competition in the sale of vehicles. The regulations <br />will directly advance the City's interests in public safety, efficient traffic <br />22 flow, aesthetics and economic fairness by prohibiting vehicle sales on <br />properties that are not zoned for such activities and properties that <br />23 developed the appropriate infrastructure and amenities to safely <br />24 accommodate such sales. <br />25 (3) These regulations are reasonably tailored to serve the City's <br />substantial interests in public safety, efficient traffic flow, aesthetics <br />26 and economic fairness because they do not restrict the ability of any <br />27 persons to advertise that their vehicle is for sale in lots that are <br />appropriately zoned nor do they restrict the ability of persons to have <br />28 signs in or on their vehicles advertising the vehicle's availability or <br />other commercial interests.
