4.0 1 DEVELOPMENT REGULATIONS <br />be permitted, subject to Section 7.3.9, Minor Modifications, without an <br />amendment to the CHCCSP. <br />Non -Conforming Uses and Structures <br />Refer to Section 7.0 and the City of Colton Zoning Ordinance, Title 18, of the <br />Municipal Code for treatment of non -conforming uses and structures within the <br />CHCCSP. <br />Off -Street Parking And Loading <br />Except as specified inthis document, parkingand loadingrequirements shallbe <br />pursuantto the City ofColtonZoningOrdinance, Title 18oftheMunicipalCode. <br />Conditions, Covenants And Restrictions (CC& R's) <br />CC&Rs shall be provided to the City for review and approval upon submittal of <br />an application for improvement plans and / or a final map, whichever comes <br />first. Among other requirements, all CC&Rs shall establish recreational vehicle <br />(RV) parking requirements on private streets, driveways and parking lots. Such <br />CC&Rs shall at a minimum limit RV parking to no longer than seventy-two (72) <br />hours on any private or public street, driveway or other location in a residential <br />or commercial areas, unless such commercial area is specifically permits such use. <br />Any private streets or alleys on a development application shall include provisions <br />to assure they are permanently reserved and maintained for their intended purpose <br />by a means acceptable to and enforceable by the City of Colton. <br />Severability <br />In the event that any regulation, condition, program, portion or policy of the <br />CHCCSP or the application thereof to any person or circumstance is held to be <br />invalid or unconstitutional by any court of competent jurisdiction, such portions <br />shall be deemed separate, distinct and independent provisions and shall not affect <br />the validity of the remaining provisions of the CHCCSP or applications thereof <br />which can be implemented without the invalid provision or application. <br />Interpretation <br />Any ambiguities related to the implementation of the provisions of the CHCCSP <br />shall be resolved by the City of Colton's Development Services Director or his/her <br />designee. Such interpretations shall take into account the stated goals and intent <br />of the CHCCSP. Any interpretation made by the Development Services Director <br />may be appealed to the Planning Commission. The decision of the Planning <br />Commission shall be final unless appealed to the City Council. <br />Definitions <br />Unless otherwise specified herein, terms used in this document shall have the <br />same definitions provided in the City of Colton Zoning Ordinance, "Definitions." <br />
