3. Designated City Attorney. Sonia Rubio Carvalho of Best Best & Krieger shall <br />be designated as City Attorney. John E. Brown of Best Best & Krieger LLP will also provide <br />services, as needed. Mr. Brown and Ms. Carvalho shall be responsible for the performance of <br />Services under this Agreement and the supervision of Services performed by other members of <br />Best Best & Krieger LLP. No change in this assignment shall be made without the consent of the <br />City. <br />4. Time of Performance. The Services of Best Best & Krieger LLP shall be <br />performed expeditiously in light of the purposes of this Agreement. <br />5. Compensation. <br />(a) Basic Legal Services. The City and Agency shall pay Best Best & <br />Krieger LLP a blended hourly billing rate of One Hundred and Fifty -Five Dollars ($155.00) per <br />hour for attorneys and Ninety -Five Dollars ($95.00) per hour for paralegals and clerks in <br />compensation for Best Best & Krieger LLP's performance of the Services. <br />(b) Reimbursement. The City shall reimburse Best Best & Krieger LLP <br />for such printing and copying expenses, mileage expenses, telephone tolls, court fees, computer <br />time, and similar costs relating to the Services that are generally chargeable to a client. <br />(c) Bond Counsel Services. In connection with all tax exempt or <br />taxable financings undertaken by the City, unless otherwise agreed by the parties hereto, all bond <br />counsel and special counsel legal services necessary for issuance of tax exempt or taxable <br />RVPUBVEB143159 -3 - <br />
