securities shall be provided when requested by the City at its election and rendered at rates on file <br />with the City's Finance Director. Appropriate adjustments may be made to the rates on file as <br />recommended from time to time by underwriters and/or financial advisors for the City. <br />(d) Litigation Services. The City and Agency shall pay Best Best & <br />Krieger LLP an hourly billing rate of One Hundred Seventy -Five Dollars ($175.00) per hour for <br />Litigation Partners; One Hundred and Fifty Dollars ($150.00) per hour for Litigation Associates; <br />and Ninety Dollars ($90.00) per hour for paralegals and clerks in compensation for Best Best & <br />Krieger LLP's performance of litigation services. <br />(e) Billing. Best Best & Krieger LLP shall submit monthly to the City <br />a detailed statement of account for Services. The City shall review Best Best & Krieger LLP's <br />monthly statements and pay Best Best & Krieger LLP for Services rendered and costs incurred, <br />as provided for in this Agreement, on a monthly basis. <br />(f) Cap on Legal Fees: Extraordinary Services. City shall not pay Best <br />Best & Krieger LLP more than a total of Five Hundred Fifty Thousand Dollars ($550,000) in the <br />period from July 1, 1998, to June 30, 1999 ("Compensation Cap"), except that the Compensation <br />Cap shall not apply to Extraordinary Services. Compensation payable from the City of Colton <br />Redevelopment Agency to Best Best & Krieger LLP shall not be included in the Compensation <br />Cap.
