• Complex Tort Litigation, including wrongful death claims <br />0 Matters that either in nature or scope are unusual, unexpected and/or <br />complex involving the City or its elected officials, officers or employees <br />0 Elective litigation initiated at the City Council's request <br />If Best Best & Krieger LLP believes that a matter falls within the Extraordinary Services category <br />described herein, Best Best & Krieger LLP shall seek for written approval from the City Manager, <br />which approval shall not be unreasonably withheld, to deem such matter as Extraordinary Services <br />and upon such approval, the City Manager shall either approve referral of the matter to special <br />legal counsel as recommended by Best Best & Krieger LLP or pay Best Best & Krieger LLP for <br />all services provided in connection with such matter according to the rates described in Section <br />5(a). A list of the matters Best Best & Krieger LLP is currently handling on behalf of the City, <br />and which the City agrees fall within the Extraordinary Services category, is contained in the <br />attached Exhibit "A" and incorporated herein by the reference. <br />6. Insurance Coverage. Best Best & Krieger LLP carries errors and omissions <br />insurance with Lloyd's of London. After a standard deductibility amount, this insurance provides <br />coverage which exceeds that which is required by the State of California. <br />7. Relationship With Special Legal Counsel. Best Best & Krieger LLP shall <br />oversee all legal services provided by special legal counsel. When and if necessary, Best Best & <br />Krieger LLP may call upon any of those individuals and law firms listed below to continue to <br />provide special legal services to the City.
