In addition, the Subject Site will be developed <br />utilizing the development standards that have been established for the Specific Plan. <br />SECTION 5. In considering this Specific Plan Amendment, the City Council has <br />determined that the Specific Plan Amendment promotes greater design flexibility and encourages <br />more economical and efficient use of land because: The existing condition of the Subject Site is not <br />contributing to the goals and objectives of the Specific Plan. The proposed project, as designed, will <br />create an economical and efficient use of the land. It has been designed to maximize the full use of <br />the land for the storage of salvaged autos, provide adequate parking facilities for employees and <br />customers, and maintain sufficient landscaped areas to provide for an aesthetically pleasing industrial <br />operation along one of the City's major thoroughfares (La Cadena Drive). <br />SECTION 6. Based on the entire record before the City Council and all written and <br />oral evidence presented, the City Council finds the proposed Specific Plan Amendment complies with <br />CEQA and hereby adopts the negative declaration for the following reasons: <br />A. The negative declaration and initial study that were prepared for the <br />Application contain a complete and accurate reporting of the environmental impacts associated with <br />the Application. The documents have been completed in compliance with CEQA and the State CEQA <br />Guidelines. <br />B. The negative declaration and initial study prepared for the Application reflect <br />the independent judgment of the City Council. <br />C. As the decision making body for the Application, the City Council reviewed <br />and considered the information contained in the negative declaration, initial study and administrative <br />record prior to approving the Application. <br />D. All environmental impacts of the Application are insignificant. There is no <br />substantial evidence in the record supporting a fair argument that the Application will result in <br />significant impacts. <br />E. The Application will not result in any changes to the following resources: (1) <br />riparian land, rivers, streams, watercourses and wetlands; (2) native and non-native plant life and the <br />soil required to sustain habitat for fish and wildlife; (3) rare and unique plant life and ecological <br />communities dependant on plant life; (4) listed threatened and endangered plants and animals and the <br />habitat in which they are believed to reside; (5) all species listed as protected or identified for special <br />management in the Fish and Game Code, the Public Resources Code, the Water Code or regulations <br />RVPLJB\NVM534103 3 <br />
