In addition, the Subject Site will be developed utilizing the development standards that have been established for the Specific Plan. SECTION 5. In considering this Specific Plan Amendment, the City Council has determined that the Specific Plan Amendment promotes greater design flexibility and encourages more economical and efficient use of land because: The existing condition of the Subject Site is not contributing to the goals and objectives of the Specific Plan. The proposed project, as designed, will create an economical and efficient use of the land. It has been designed to maximize the full use of the land for the storage of salvaged autos, provide adequate parking facilities for employees and customers, and maintain sufficient landscaped areas to provide for an aesthetically pleasing industrial operation along one of the City's major thoroughfares (La Cadena Drive). SECTION 6. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds the proposed Specific Plan Amendment complies with CEQA and hereby adopts the negative declaration for the following reasons: A. The negative declaration and initial study that were prepared for the Application contain a complete and accurate reporting of the environmental impacts associated with the Application. The documents have been completed in compliance with CEQA and the State CEQA Guidelines. B. The negative declaration and initial study prepared for the Application reflect the independent judgment of the City Council. C. As the decision making body for the Application, the City Council reviewed and considered the information contained in the negative declaration, initial study and administrative record prior to approving the Application. D. All environmental impacts of the Application are insignificant. There is no substantial evidence in the record supporting a fair argument that the Application will result in significant impacts. E. The Application will not result in any changes to the following resources: (1) riparian land, rivers, streams, watercourses and wetlands; (2) native and non-native plant life and the soil required to sustain habitat for fish and wildlife; (3) rare and unique plant life and ecological communities dependant on plant life; (4) listed threatened and endangered plants and animals and the habitat in which they are believed to reside; (5) all species listed as protected or identified for special management in the Fish and Game Code, the Public Resources Code, the Water Code or regulations RVPLJB\NVM534103 3
