EXHIBIT A <br />arbitrator. Unless the parties agree to another method of selecting an <br />arbitrator, the parties shall alternately strike one name from the list until <br />one name remains. The right to strike the first name is determined by lot. <br />C. Private Hearing - Grievance arbitration hearing shall be open or closed at <br />the choice of the appellant or grievant. <br />D. Cost and Expenses — Each party shall bear equally the cost of the fees and <br />expenses of the arbitrator and court reporter, if any. Each party shall bear <br />its own witness and attorney fees. <br />E. The arbitrator shall render a decision in writing within 30 days of the close <br />of the hearing or of his/her receipt of closing briefs, whichever is later. <br />The decision of the arbitrator is final and binding and is not subject to any <br />administrative or judicial review except pursuant to the Civil Code <br />Procedure Section 1286.2." <br />X. SALARY: The City will provide to all unit employees a base salary increase of <br />5.5% effective July 1, 2001. The City will contract with a mutually agreed upon <br />consultant to complete a compensation study and will implement the <br />compensation study effective January 1, 2002, and will provide a 4% salary <br />increase to unit employees effective July 1, 2002. <br />XI. RETIREMENT: The City agrees to re -open for the purpose of meet and confer <br />should any legislation pass that has the potential to enhance the PERS retirement <br />benefit. <br />XII. ACTING PAY: The period of time for an employee who is assigned to work in a <br />higher classification for a period of 80 consecutive work hours or more shall <br />receive compensation from the first day will be revised to a period of 39 hours or <br />more shall receive compensation from the first hour at A step of the higher <br />classification or S%, whichever is higher. <br />XIII. SPECIAL ASSIGNMENT COMPENSATION: _ Employees who have been <br />given the temporary assignment involving the performance of more difficult <br />duties and requiring a greater level of skill(s) or duties outside of their <br />classification maybe granted additional compensation. <br />The duration of such assignments is not intended to exceed one (1) year. This <br />provision shall not be used to circumvent the merit system of promotion or the <br />provisions for reclassification. The specific, temporary assignment duties must be <br />identified in writing prior to the start of the assignment. <br />Compensation: Compensation shall be awarded in pay period increments. <br />(a) Special assignment compensation shall be in the form of a specified <br />percentage of the employee's base pay. The Human Resources Manager <br />will determine the amount in increments of one percent (1%) from a <br />minimum of two percent (2%) up to a maximum of five percent (5%). <br />
