1 <br /> WHEREAS, the City has conducted an analysis of the Project, consistent with CEQA <br /> 2 Guidelines section 15183 ("Section 15183 Analysis"), and found that it is in conformance with the <br /> analysis and conclusions of the General Plan EIR, that there are no new significant off-site or <br /> 3 cumulative impacts that were not analyzed in the General Plan EIR, that there are no adverse <br /> 4 impacts that are more severe than those previously identified in the General Plan EIR. <br /> NOW,THEREFORE,BE IT RESOLVED BY THE PLANNING COMMISSION OF <br /> 5 THE CITY OF COLTON: <br /> 6 SECTION 1. The City Council finds that the Section 15183 Analysis has been completed <br /> 7 in compliance with CEQA, the CEQA Guidelines, and that the Section 15183 Analysis and <br /> supporting materials,taken together,reflect the Commission's independent judgment. <br /> 8 SECTION 2. COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL <br /> 9 QUALITY ACT. As a decision-making body for the Project, the City Council has reviewed and <br /> considered the information contained in the Section 15183 Analysis, comments received,and other <br /> 10 documents contained in the administrative record for the Project. Based on the Commission's <br /> 11 independent review and analysis it finds that the Section 15183 Analysis and administrative record <br /> contain a complete and accurate reporting of the environmental impacts associated with the <br /> 12 modified project, and that the Section 15183 Analysis has been completed in compliance with <br /> CEQA and the State CEQA Guidelines. <br /> 13 <br /> SECTION 3. FINDINGS ON ENVIRONMENTAL IMPACTS. Based on the whole <br /> 14 record before it, including the Section 15183 Analysis, the administrative record, and all other <br /> written and oral evidence, the City Council finds that all environmental impacts of the Project <br /> 15 (DAP-001-668 and DAP-001-716) are either less than significant or can be mitigated to a level of <br /> 16 less than significant under the mitigation measures outlined in the Section 15183 Analysis, <br /> alternatively, there is no substantial evidence in the administrative record supporting a fair <br /> 17 argument that the modified project may result in any significant environmental impacts. The City <br /> Council finds that the Section 15183 Analysis contains a complete, objective, and accurate <br /> 18 reporting of the environmental impacts associated with the,Project and reflects the independent and <br /> 19 analysis of the City Council. <br /> 20 SECTION 4. ADOPTION OF THE SECTION 15183 ANALYSIS. The City Council <br /> hereby approves and adopts the Section 15183 Analysis. <br /> 21 SECTION 5. ADOPTION OF THE MITIGATION MONITORING AND <br /> 22 REPORTING PROGRAM. In accordance with Public Resources Code section 21081.6,the City <br /> Council hereby adopts the MMRP previously adopted for the General Plan EIR as it pertains to the <br /> 23 Project. In the event of any inconsistencies between the Mitigation Measures as set forth in the <br /> 24 Section 15183 Analysis and the MMRP,the MMRP shall control. <br /> 25 SECTION 6. Based on the entire record and all written and oral evidence presented, <br /> 26 including the staff reports, the City Council upholds the following findings made by the Planning <br /> Commission for approval of the Architectural and Site Plan Review (DAP-001-716) for 1400 <br /> 27 Agua Mansa Road: <br /> 28 <br />
