1 WHEREAS, the City has conducted an analysis of the Project, consistent with CEQA 2 Guidelines section 15183 ("Section 15183 Analysis"), and found that it is in conformance with the analysis and conclusions of the General Plan EIR, that there are no new significant off-site or 3 cumulative impacts that were not analyzed in the General Plan EIR, that there are no adverse 4 impacts that are more severe than those previously identified in the General Plan EIR. NOW,THEREFORE,BE IT RESOLVED BY THE PLANNING COMMISSION OF 5 THE CITY OF COLTON: 6 SECTION 1. The City Council finds that the Section 15183 Analysis has been completed 7 in compliance with CEQA, the CEQA Guidelines, and that the Section 15183 Analysis and supporting materials,taken together,reflect the Commission's independent judgment. 8 SECTION 2. COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL 9 QUALITY ACT. As a decision-making body for the Project, the City Council has reviewed and considered the information contained in the Section 15183 Analysis, comments received,and other 10 documents contained in the administrative record for the Project. Based on the Commission's 11 independent review and analysis it finds that the Section 15183 Analysis and administrative record contain a complete and accurate reporting of the environmental impacts associated with the 12 modified project, and that the Section 15183 Analysis has been completed in compliance with CEQA and the State CEQA Guidelines. 13 SECTION 3. FINDINGS ON ENVIRONMENTAL IMPACTS. Based on the whole 14 record before it, including the Section 15183 Analysis, the administrative record, and all other written and oral evidence, the City Council finds that all environmental impacts of the Project 15 (DAP-001-668 and DAP-001-716) are either less than significant or can be mitigated to a level of 16 less than significant under the mitigation measures outlined in the Section 15183 Analysis, alternatively, there is no substantial evidence in the administrative record supporting a fair 17 argument that the modified project may result in any significant environmental impacts. The City Council finds that the Section 15183 Analysis contains a complete, objective, and accurate 18 reporting of the environmental impacts associated with the,Project and reflects the independent and 19 analysis of the City Council. 20 SECTION 4. ADOPTION OF THE SECTION 15183 ANALYSIS. The City Council hereby approves and adopts the Section 15183 Analysis. 21 SECTION 5. ADOPTION OF THE MITIGATION MONITORING AND 22 REPORTING PROGRAM. In accordance with Public Resources Code section 21081.6,the City Council hereby adopts the MMRP previously adopted for the General Plan EIR as it pertains to the 23 Project. In the event of any inconsistencies between the Mitigation Measures as set forth in the 24 Section 15183 Analysis and the MMRP,the MMRP shall control. 25 SECTION 6. Based on the entire record and all written and oral evidence presented, 26 including the staff reports, the City Council upholds the following findings made by the Planning Commission for approval of the Architectural and Site Plan Review (DAP-001-716) for 1400 27 Agua Mansa Road: 28
