1 as might be necessary to examine whether there are project-specific significant effects which are <br /> 2 peculiar to the project or its site; and <br /> WHEREAS, developer IDI Logistics is seeking City approvals to allow for the <br /> 3 construction and operation of a warehouse/office building at 1400 Agua Mansa Road <br /> 4 ("Project");and <br /> 5 WHEREAS, the City has conducted an analysis of the Project, consistent with CEQA <br /> Guidelines section 15183 ("Section 15183 Analysis"), and found that it is in conformance with <br /> 6 the analysis and conclusions of the General Plan EIR,that there are no new significant off-site or <br /> cumulative impacts that were not analyzed in the General Plan EIR, that there are no adverse <br /> 7 impacts that are more severe than those previously identified in the General Plan EIR. <br /> 8 NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION <br /> OF THE CITY OF COLTON: <br /> 9 <br /> SECTION 1. RECITALS. The Planning Commission finds that the Section 15183 <br /> 10 Analysis has been completed in compliance with CEQA, the CEQA Guidelines, and that the <br /> 11 Section 15183 Analysis and supporting materials, taken together, reflect the reflect the Planning <br /> Commission's independent judgment as reviewed and approved on May 9, 2023 and upheld on <br /> 12 appeal by the City Council on June 20, 2023 and July 18, 2023. <br /> 13 SECTION 2. COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL <br /> QUALITY ACT. As a decision-making body for the Project,the Planning Commission and City <br /> 14 Council have reviewed and considered the information contained in the Section 15183 Analysis, <br /> comments received, and other documents contained in the administrative record for the Project. <br /> 15 Based on the Commission's independent review and analysis it finds that the Section 15183 <br /> 16 Analysis and administrative record contain a complete and accurate reporting of the <br /> environmental impacts associated with the modified project, and that the Section 15183 Analysis <br /> 17 has been completed in compliance with CEQA and the State CEQA Guidelines. <br /> 18 SECTION 3. FINDINGS ON ENVIRONMENTAL IMPACTS. Based on the whole <br /> record before it, including the Section 15183 Analysis, the administrative record, and all other <br /> 19 written and oral evidence, the Planning Commission finds that all environmental impacts of the <br /> 20 Project (DAP-001-716) are either less than significant or can be mitigated to a level of less than <br /> significant under the mitigation measures outlined in the Section 15183 Analysis, alternatively, <br /> 21 there is no substantial evidence in the administrative record supporting a fair argument that the <br /> modified project may result in any significant environmental impacts. The Planning Commission <br /> 22 and City Council found that the Section 15183 Analysis contains a complete, objective, and <br /> accurate reporting of the environmental impacts associated with the Project and continues to <br /> 23 reflect the independent and analysis of the Planning Commission on May 9, 2023 and by City <br /> 24 Council on Appeal held on June 20, 2023. <br /> 25 SECTION 4. ADOPTION OF THE SECTION 15183 ANALYSIS. The Planning <br /> Commission approved and adopted Section 15183 Analysis on May 9,2023 and upheld on appeal <br /> 26 by the City Council on June 20, 2023. <br /> 27 SECTION 5. ADOPTION OF THE MITIGATION MONITORING AND <br /> REPORTING PROGRAM. In accordance with Public Resources Code section 21081.6, the <br /> 28 <br />
