1 WHEREAS, on March 19, 2024 the City of Colton City Council conducted a public <br /> 2 hearing on the application and all persons wishing to testify in connection with the application <br /> 3 were heard, and the applications were comprehensively reviewed. <br /> 4 WHEREAS, pursuant to CEQA, when taking subsequent discretionary actions in <br /> 5 furtherance of a project for which an EIR has been certified, the lead agency is required to <br /> 6 review any changed circumstances to determine whether any of the circumstances under <br /> Public Resources Code section 21166 and State CEQA Guidelines section 15162 require <br /> 7 additional environmental review, and <br /> 8 <br /> 9 WHEREAS, the City has evaluated the proposed amendments to the Project, <br /> including the Amendment to Tentative Tract Map No. 16798, in light of the standards for <br /> 10 subsequent environmental review outlined in Public Resources Code section 21166 and State <br /> 11 CEQA Guidelines section 15162, and concluded that the proposed changes would not result <br /> 12 in new significant environmental effects or a substantial increase in the severity of previously <br /> identified significant effects that were previously disclosed in the certified EIR, and therefore <br /> 13 <br /> no subsequent EIR or mitigated negative declaration is required, and <br /> 14 <br /> 15 WHEREAS, the proposed changes would nonetheless necessitate minor changes or <br /> additions to the certified EIR and thus, in full compliance with CEQA, the City has prepared <br /> 16 an Addendum for the Project (Addendum), attached as Exhibit A to the certified EIR <br /> 17 pursuant to State CEQA Guidelines section 15164 to address the changes in environmental <br /> 18 effects associated with the minor changes to the Project, and <br /> 19 <br /> WHEREAS, the City Council has reviewed and considered the Addendum prior to <br /> 20 approving the Amendment to Tentative Tract Map No. 16798; and <br /> 21 <br /> 22 WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br /> occurred. <br /> 23 <br /> 24 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br /> 25 Colton does hereby find, determine and declare as follows: <br /> 26 SECTION 1. State CEQA Guidelines section 15164 requires lead agencies to prepare <br /> 27 an addendum to a previously certified EIR if some changes or additions to the project are <br /> 28 necessary, but none of the conditions requiring preparation of a subsequent EIR are present. <br /> The City Council has reviewed and considered the administrative record, including but not <br /> limited to the previously certified EIR and the Addendum, which are all incorporated by <br /> 2 <br />
