1 reference as though set forth fully herein, and finds that those documents taken together <br /> 2 contain a complete and accurate reporting of all the environmental impacts associated with the <br /> 3 Project changes. The City Council further finds that the Addendum and the administrative <br /> record have been completed in compliance with CEQA, the State CEQA Guidelines, and the <br /> 4 City's Local Guidelines. The City Council finds and determines that the Addendum reflects <br /> 5 the City's independent judgment. <br /> 6 <br /> Furthermore, when taking subsequent discretionary actions in furtherance of a project for <br /> 7 which an EIR has been certified, the City is required to review any changed circumstances <br /> 8 under Public Resources Code section 21166 and State CEQA Guidelines section 15162 to <br /> 9 determine whether additional environmental review is required. Based on the substantial <br /> evidence set forth in the administrative record, including but not limited to certified EIR and <br /> 10 <br /> the Addendum, the City Council finds that none of the conditions under State CEQA <br /> 11 Guidelines section 15162 requiring subsequent environmental review have occurred because <br /> 12 the Project changes: <br /> 13 <br /> 14 a) do not constitute substantial changes that would require major revisions to the 2006 <br /> Final EIR due to the involvement of new significant environmental effects or a substantial <br /> 15 <br /> increase in the severity of previously identified effects; and <br /> 16 <br /> 17 b) do not constitute substantial changes with respect to the circumstances under which <br /> the project was developed that would require major revisions of the EIR due to the <br /> 18 involvement of new significant environmental effects or a substantial increase in the <br /> 19 severity of the previously identified significant effects; and <br /> 20 c) do not present new information or substantial importance that was not known and <br /> 21 could not have been known with the exercise of reasonable diligence at the time the EIR <br /> 22 was certified, showing any of the following: (i) that the project would have one or more <br /> significant effects not discussed in the earlier environmental documentation; (ii) that <br /> 23 <br /> significant effects previously examined would be substantially more severe than shown in <br /> 24 the earlier environmental documentation; (iii) that mitigation measures or alternatives <br /> 25 previously found not to be feasible would in fact be feasible and would substantially <br /> 26 reduce one or more significant effects, but the applicant declined to adopt such measures; <br /> or (iv) that mitigation measures or alternatives considerably different from those <br /> 27 previously analyzed would substantially reduce one or more significant effects on the <br /> 28 environment, but which the applicant declined to adopt. <br /> 3 <br />
