Based on the entire record before the City Council, all written <br />and oral evidence presented to the City Council, and the findings set forth in this Ordinance, <br />the City Council of the City of Colton hereby designates the Subject Site shown on the <br />attached Exhibit Al as within the "R-1" (Single Family Residential) zoning district as defined <br />in Chapter 18.12 of the Colton Municipal Code. <br />SECTION 2. Based on the entire record before the City Council and all <br />written and oral evidence presented, the City Council finds that the Application is consistent <br />with the City of Colton General Plan ("General Plan"), and will systematically implement the <br />goals and objectives of the General Plan. Moreover, the City Council hereby makes the <br />following specific findings in accordance with Section 18.58.050 of the Colton Municipal <br />Code and state law: <br />A. The proposed zone change is in conformity with the General Plan of <br />the City. The proposed change in designation to R-1 is consistent with the General Plan <br />Land Use Designation of "Single Family Residential." In addition, the R-1 zoning designation <br />provides for land uses compatible with existing and surrounding property. <br />B. The proposed pre -zone change is reasonable and beneficial at this <br />time because it will not be a significant change from the existing uses on the Subject Site. <br />C. The proposed pre -zone will not adversely affect the surrounding area <br />or the community in general. The Subject Site is surrounded by other residential uses. <br />D. In considering this change of zone, the City has considered the <br />housing needs of the region and balanced those needs against the public service needs of <br />the residents and available fiscal and environmental resources. The redesignation of this <br />property does not impact the City's ability to meet its housing needs as there are still a <br />sufficient number of properties in the City that are zoned for more intense residential uses <br />that can accommodate the City's housing needs. <br />SECTION 3. Based on the entire record before the City Council and all <br />written and oral evidence presented, the City Council finds that the proposed pre -zone is also <br />reasonably related to the public welfare since the R-1 zone designation promotes <br />consistency with the City's general plan and promotes the maintenance of the character of <br />the subject area as a single family residential area. <br />SECTION 4. The City Council, in accordance with the California <br />Environmental Quality Act (CEQA), the City of Colton implementing procedures for CEQA <br />and the State CEQA Guidelines, hereby determines that this action is categorically exempt <br />pursuant to California Environmental Quality Act (CEQA) Guidelines Sections 15305 and <br />15183. As noted the subject area is already developed with single family residential <br />structures, consistent with the existing General Plan Land Use Designation of Low Density <br />Residential." Pre -zoning the subject area R-1 (Single Family Residential) will make the <br />applicable zoning designation consistent with the existing General Plan Land Use <br />Designation. Further, since the area is built -out with existing structures, there are no project - <br />specific significant effects. Further, none of the conditions described in CEQA Guidelines <br />Section 15300.2 exist. Staff is directed to file a Notice of Exemption upon approval of the <br />proposed pre -zone ordinance with the San Bernardino County Clerk's office. <br />4 <br />
