b. Use appropriate safeguards to prevent the use or disclosure of PHI, other than as provided for in this Agreement, and c. Provide a written report to Agency of any use or disclosure of PHI not authorized in this Agreement ("Unauthorized Use") promptly after learning of the Unauthorized Use; and d. Ensure that any agents, including, but not limited to, contractors and subcontractors, to which Contractor provides PHI received from Agency, or created or received by Contractor on behalf of Agency, agrees in writing to the same restrictions contained in this Agreement with respect to PHI; and e. Unless otherwise notified by Agency in writing, make available to individuals, who are the subject of PHI received or created by Contractor, the PHI of such individuals for inspection and copying in accordance with applicable law and the privacy policies of Agency in effect from time to time and provided to Contractor; and f. Unless otherwise notified by Agency in writing, make available to individuals, who are the subject of PHI receive4d or created by Contractor, the PHI of such individuals for amendment, and incorporate such amendments in accordance with applicable law and the privacy policies of Agency in effect from time to time and provided to Contractor; and g. Unless otherwise notified by Agency in writing, make available to individuals, who are the subject of PHI received or created by Contractor, any and all PHI required for an accounting of disclosures by Agency in effect from time to time and provided to Contractor; and h. Make Contractor's internal practices, books and records relating to the use and disclosure of PHI received from or created or received by Contractor on behalf of Agency available to the Secretary of Health and Human Services or his/her designee for purposes of determining Agency's compliance with the HIPAA rule; and i. Return all PHI received from, or created or received by Contractor on behalf of Agency immediately upon termination of this Agreement. Contractor will not retain any copies of PHI. If contractor is unable to return PHI immediately upon termination of this Agreement, then Contractor will notify Agency within ten (10) calendar days with an explanation of when PHI will be returned, or, if return of PHI is not feasible, that contractor will destroy all PHI within ten (10) calendar days of such notice; and j.
