b. Use appropriate safeguards to prevent the use or disclosure of <br />PHI, other than as provided for in this Agreement, and <br />c. Provide a written report to Agency of any use or disclosure of <br />PHI not authorized in this Agreement ("Unauthorized Use") <br />promptly after learning of the Unauthorized Use; and <br />d. Ensure that any agents, including, but not limited to, <br />contractors and subcontractors, to which Contractor provides <br />PHI received from Agency, or created or received by <br />Contractor on behalf of Agency, agrees in writing to the same <br />restrictions contained in this Agreement with respect to PHI; <br />and <br />e. Unless otherwise notified by Agency in writing, make available <br />to individuals, who are the subject of PHI received or created <br />by Contractor, the PHI of such individuals for inspection and <br />copying in accordance with applicable law and the privacy <br />policies of Agency in effect from time to time and provided to <br />Contractor; and <br />f. Unless otherwise notified by Agency in writing, make available <br />to individuals, who are the subject of PHI receive4d or created <br />by Contractor, the PHI of such individuals for amendment, and <br />incorporate such amendments in accordance with applicable <br />law and the privacy policies of Agency in effect from time to <br />time and provided to Contractor; and <br />g. Unless otherwise notified by Agency in writing, make available <br />to individuals, who are the subject of PHI received or created <br />by Contractor, any and all PHI required for an accounting of <br />disclosures by Agency in effect from time to time and provided <br />to Contractor; and <br />h. Make Contractor's internal practices, books and records <br />relating to the use and disclosure of PHI received from or <br />created or received by Contractor on behalf of Agency <br />available to the Secretary of Health and Human Services or <br />his/her designee for purposes of determining Agency's <br />compliance with the HIPAA rule; and <br />i. Return all PHI received from, or created or received by <br />Contractor on behalf of Agency immediately upon termination <br />of this Agreement. Contractor will not retain any copies of PHI. <br />If contractor is unable to return PHI immediately upon <br />termination of this Agreement, then Contractor will notify <br />Agency within ten (10) calendar days with an explanation of <br />when PHI will be returned, or, if return of PHI is not feasible, <br />that contractor will destroy all PHI within ten (10) calendar days <br />of such notice; and <br />j.
