R -09-09 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />ADOPTING A POLICY FOR THE RETENTION AND DESTRUCTION OF <br />OBSOLETE RECORDS OF THE CITY AND REPEALING RESOLUTION <br />NO. R-132-89 <br />WHEREAS, Section 34090 of the California Government Code provides that, with <br />the approval of the City Council by resolution and the written consent of the City Attorney, <br />the head of a city department may destroy any record, document, instrument, book or paper <br />under his or her charge without making a copy thereof, after the same is no longer required, <br />provided that certain records are exempt from such destruction; and <br />WHEREAS, the City Council previously adopted Resolution No. R-132-89 which <br />authorized the destruction of certain City records as provided by Section 34090; and <br />WHEREAS, since the adoption of Resolution No. R-132-89, the laws pertaining to <br />records retention and destruction for cities have changed to reflect the various formats in <br />which City records are created and stored; and <br />WHEREAS, City staff has prepared a "Records Retention and Destruction Policy" <br />and a "Records Retention Schedule" which contain current information on legally required <br />retention periods for City records established by the California Government Code and other <br />State and federal laws and regulations, as well as information from the California Secretary <br />of State's Local Government Records Management Guidelines; and <br />WHEREAS, the City Council recognizes the City's need for an updated records <br />retention and destruction program and wishes to adopt the proposed "Records Retention <br />and Destruction Policy" and "Records Retention Schedule." <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />Section 1. Resolution No. R-132-89 is hereby repealed. <br />Section 2. The City Council hereby adopts the "Records Retention and Destruction <br />Policy" with its attached "Records Retention Schedule," which are attached hereto as <br />Exhibit "A" and incorporated herein and made a part of this Resolution. <br />ONTARIO\NSTUBB S\301911.1 <br />1 <br />
