Mr. Schultz, representing Mr. Charles Paul, questioned whether the proposed amendment A <br />was in compliance with the California Environmental Quality Act (CEQA). The City's <br />Counsel, Ms. Julie Biggs, responded by informing the Commission that it was her legal <br />opinion that the proposed amendment is not a project, as defined by CEQA, and therefore <br />is exempt from the process. Attached, please find the notice of exemption. G <br />RECOMMENDATION: <br />Based on the above report, staff recommends approval of File Index Number DO -1-93 as E <br />originally presented to the Planning Commission, allowing composting only in the M-1 or <br />M-2 Zones with an approved conditional use permit, amending sections 18.06.060 and <br />18.04 of the Colton Municipal Code. Should the Council approve staff's recommendation, N <br />then adoption of the attached ordinance approving such would be in order; however, if <br />the Council approves the Planning Commission's recommendation, adoption of the <br />attached ordinance additionally allowing composting in an Agricultural Zone, with an <br />approved Conditional Use Permit, would be in order.
