12/3/sz <br />AGREEMENT TO TERMINATE <br />IX DEMONSTRATION SYSTEM AGREFMENTs <br />THIS AGREEMENT is made this day of <br />, 2993, <br />by and between the CITY OF COLTON, a public agency g Y ("CDLTON" � , the <br />CITY OF SAN BERNARDINO, a public agency, acting by and through its <br />Board of Water Commissioners ("SAN BERNARDINO"), and SANTA ANA <br />WATERSHED PROJECT AUTHORITY, a joint powers public agency ("SAWPA"). <br />COLTON, SAN BERNARDINO and SAWPA are sometimes referred to herein <br />individually, as "PARTY" or collectively as the "PARTIES". <br />RECITALS <br />A. Pursuant to previous agreements, the PARTIES have examined <br />the feasibility of jointly constructing and operating a regional <br />system that will provide tertiary treatment and reclamation of <br />wastewater produced by COLTON's Wastewater treatment plant and SAN <br />BERNARDINO's wastewater treatment plant for disposal in the Santa <br />Ana River. <br />B. Thereafter, the PARTIES determined to implement a <br />demonstration -scale regional tertiary treatment and Water <br />reclamation system, which demonstration project was funded by COLTON <br />and SAN BERNARDINO and administered can their behalf by SAWPA.. <br />C. The 'PARTIES have determined that the demonstration system <br />can be successfully implemented on a larger scale for the purpose of <br />treating all of the secondarily -treated wastewater of COLTON and SAN <br />{ <br />
