1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />2.1.2: Use its best efforts to acquire the entirety of the CAMC Lands, <br />with the understanding the acquisition of the entirety of the property and the <br />preservation of approximately 160 acres thereof is a prerequisite for the project as <br />a whole to proceed. <br />2.1.3: Dedicate the remainder of the CAMC lands, approximately 160 <br />acres, ("Conserved Lands") to such entity or entities as it shall be directed by the <br />Service to be conserved, protected, restored and enhanced by such entity for the <br />benefits of the DSF and such other species as may be found to exist on the <br />Conserved Lands. <br />2.1.4: Provide $1,000,000, upon such terms as the Service and the City <br />shall agree, as an endowment, the income from which will be used exclusively to <br />manages and protect the Conserved Lands. <br />2.1.5: Provide $1,000,000, upon such terms as the Service and the City <br />shall agree, payable to an entity or entities approved by the Service to assist in <br />implementing the DSF Recovery Plan. <br />2.1.6: Commence a city -side habitat conservation planning process for <br />the DSF which will encompass not only the CAMC Lands, but the entire City, <br />pursuant to the provisions of Section 10(a) of the Act, which HCP will initially <br />contemplate that the owners of all DSF habitat located north of Interstate 10 <br />within the City will be subject to appropriate mitigation, as negotiated and agreed <br />to by the parties, in order to provide further protection for the DSF and to allow <br />those lands to develop pursuant to such plan. <br />MOU - Fish & Wildlife Service and the City of Colton, California <br />Page 4 <br />
