a <br />SETTLEMENT AGREEMENT AND MUTUAL RELEASE <br />THIS SETTLEMENT AGREEMENT AND MUTUAL RELEASE <br />("Settlement Agreement") is entered into on October 21, 1997, at <br />Colton, California, by and between, on the one hand, <br />JULIE HAYWARD BIGGS, and on the other hand, CITY OF COLTON and <br />the City Council of the City of Colton as well as each <br />councilperson individually, with reference to the following: <br />RECITALS <br />1. Presently JULIE HAYWARD BIGGS is the City Attorney <br />for the City of Colton and it is her desire to resign as the City <br />Attorney on October 21, 1997, at which time it is further her <br />desire to assume the position of Legal Affairs Manager for the <br />City of Colton, which position she wishes to assume on <br />October 22, 1997 to October 22, 1998, on which date her <br />employment as a Legal Affairs Manager will terminate. It is <br />further the desire of all parties to resolve any issues <br />concerning her past and future employment as well as any and all <br />causes of action, if any, she may have against the City of <br />Colton, the City Council and/or its agents, servants and <br />employees, by this Settlement Agreement and Mutual Release. <br />2. Except as otherwise set forth in this Agreement, <br />and subject only to the terms, conditions, exceptions and <br />limitations set forth in this Agreement, it is the desire and <br />intention of each of the parties hereto: <br />(a) To fully and finally settle and resolve any <br />and all claims and disputes arising out of her employment; and <br />colton\settle.z Page 1 of 10 <br />
