(b) To terminate all controversies and other <br />matters whatsoever presently existing between them, arising out <br />of her present and future employment and any -and all disputes <br />that have arisen or may arise in connection therewith. In <br />furtherance of said desire and intention, each party hereto <br />further desires and intends to enter into certain mutual <br />releases, as set forth hereinbelow, subject only to the terms, <br />conditions, exceptions, and limitations set forth in this <br />Agreement. Furthermore, any prior agreement inconsistent with <br />these provisions as set forth herein is to be considered null and <br />void. <br />3. As used in this Agreement, the term "effective <br />time" means the time of the completion of mutual execution and <br />delivery of this Agreement by and among the parties hereto. <br />AGREEMENT <br />The parties agree as follows: <br />1. Non -admission by CITY OF COLTON and the City <br />Council. Each party understands and agrees that this Agreement <br />is a compromise and settlement of doubtful and disputed claims; <br />the acceptance of any benefits pursuant to this Agreement is <br />intended to set forth the rights of all parties as set forth on <br />page 1, paragraph 1, terminate present disputes and avoid <br />possible future litigation with respect to this subject matter or <br />any other matter between the parties; and that acceptance of <br />benefits under this Agreement is not to be construed as an <br />cotton\settle.z Page 2 of 10 <br />
