part of JULIE HAYWARD BIGGS, shall be a full, binding and <br />complete settlement between JULIE HAYWARD BIGGS and the CITY OF <br />COLTON and the City Council, collectively and individually, their <br />assigns and successors, save only the executory provisions of <br />this Settlement Agreement. <br />3. Consideration: Upon receipt of a signed original <br />counterpart of this Agreement, duly executed by CITY OF COLTON <br />and JULIE HAYWARD BIGGS, JULIE HAYWARD BIGGS shall resign from <br />the position of City Attorney for the City of Colton and shall <br />waive any claim to payment of the $104,975 in severance that <br />might otherwise be due her. Upon such resignation, the CITY OF <br />COLTON shall immediately retain JULIE HAYWARD BIGGS on a one-year <br />irrevocable contract basis as its Legal Affairs Manager at a <br />salary of $180,000 for the irrevocable one-year term of the <br />contract, together with health and dental benefits and subject to <br />continued one hundred percent (100%) contribution by the CITY OF <br />COLTON to the Public Employees Retirement System for this <br />position for the duration of the contract. No other benefits <br />shall be paid by the CITY OF COLTON to or on behalf of JULIE <br />HAYWARD BIGGS in this position by the CITY OF COLTON. Salary <br />shall be paid in accord with the normal payroll procedures of the <br />CITY OF COLTON for all regular employees and shall be subject to <br />all normal and customary deductions. <br />As the City's Legal Affairs Manager, JULIE HAYWARD <br />BIGGS shall be 'available on an as -needed basis to the CITY OF <br />COLTON for up to a maximum of 1800 billable hours during the term <br />colton\settle.2 Page 4 of 10 <br />
