L <br />her employment as City Attorney and/or as Legal Affairs Manager. <br />JULIE HAYWARD BIGGS hereby agrees to resign from her position as <br />City Attorney on October 21, 1997, at which time she shall be <br />paid all accrued salary and vacation pay up to the date of such <br />termination. <br />4. Attorneys' Fees. Each party hereto shall bear all <br />attorneys' fees and costs arising from the actions of their own <br />counsel in connection with this matter and this Settlement <br />Agreement. It is further understood that any attorneys' fees <br />pursuant to 42 U.S.C. § 1988 or any other provision of law are <br />waived. <br />S. Mutual Releases. The noun "claim" and the noun <br />"claims, wherever appearing in this Agreement, are intended and <br />shall be for all purposes deemed, construed and determined to be <br />used in the broadest reasonably plausible sense of said words, <br />and shall mean, inter alia, each and every claim, demand, <br />controversy, injury, damage, debt, liability, judgment (whether <br />in law or in equity), account, reckoning, obligation, contract, <br />agreement, cost, expense, lien, suit and action or cause of <br />action (including attorney's fees for negotiation or litigation), <br />costs paid or incurred, and other legal expenses, whether any <br />such "claims" are now existing, known or unknown, or hereafter <br />becoming known, accrued or hereafter accruing, resulting directly <br />or indirectly, proximately or remotely, from any and all of the <br />matters and things arising from any cause whatsoever prior to the <br />date this Agreement is executed. <br />colton\settle.2 Page 6 of 10 <br />
