Pursuant to Section 1541 of the California Civil Code, <br />and except as otherwise provided in this Agreement, JULIE HAYWARD <br />BIGGS hereby irrevocably and forever releases and discharges the <br />CITY OF COLTON, the City Council, each councilperson, and each <br />and every past and present attorney, agent, employee, servant, <br />director, past councilperson, successor, and other representative <br />of CITY OF COLTON. <br />In furtherance of the releases made, given and set <br />forth in any part of this Agreement, whether hereinabove, or <br />hereinbelow, each party hereto hereby acknowledges that he/she <br />has read and presently understands Section 1542 of the Civil Code <br />of the State of California, which provides as follows: <br />"A general release does not extend to claims a <br />creditor does not know or suspect to exist in his favor <br />at the time of executing the release, which if known by <br />him must have materially affected his settlement with <br />the debtor." <br />With respect to each and all of the releases made <br />hereinabove, and each and all of the releases made in any other <br />paragraph(s) of this Agreement, whether appearing hereinabove or <br />hereinbelow, each party hereto hereby irrevocably and forever <br />waives and relinquishes any and all rights and benefits which <br />he/she presently has or may have or at any time in the future <br />will or may have under and pursuant to said Section 1542, and <br />irrevocably and forever waives and relinquishes any and all <br />rights and benefits which he/she presently has or may have or at <br />any time in the future will or may have under and pursuant to any <br />and all similar provisions contained in the law. <br />colton\settze.z Page 7 of 10 <br />
