1.2.09 Award of Contract <br />The award of the Contract, if it is awarded, will be on the basis of <br />the lowest responsible bidder whose proposal complies with all the <br />requirements described. The award of the Contract, if it is awarded, <br />shall be made by the Owner within the thirty (30) calendar days after <br />the date of opening of bids. All bids will be compared on the basis <br />of the City's estimate of the quantities of work to be done. <br />1.2.10 Return vf Proposal Guaranties <br />Within ten (10) days after the award of the Contract, the Owner will <br />return the proposal guaranty accompanying the proposal which were not <br />considered in making the award. All other proposal guaranties will be <br />held until the contract has been finally executed, after which they <br />too, will be returned to the respective bidders whose proposals they <br />accompany. <br />1.2.11 Execution of Contract <br />The Contract shall be signed by the successful bidder and returned <br />together with the contract bonds within fifteen (15) calendar days <br />froID the written notice of the award. No proposal shall be considered <br />binding upon the Owner until the execution of the Contract. Failure <br />to execute a Contract and file acceptable bonds, as provided herein, <br />shall be just cause for an annulment of the award and the forfeiture <br />of the proposal guaranty. <br />1.2.12 Assi�nment of Contract <br />No assignment by the Contractor of any contract to be entered into <br />hereunder or of any part thereof, or of funds to be received <br />thereunder by the Contractor, will be recognized by the Owner unless <br />such assignment has had prior approval of the Owner and the Surety has <br />been given written notice of such assignment and has consented thereto <br />in writing. <br />1.2.13 Subcontracts <br />The bidder is specifically advised that any person, firm or other <br />party to whom it is proposed to award a subcontract under this <br />contract must be acceptable to the Owner and/or any other person, <br />persons, or agency having vested interest in the project. Although <br />the bidder is not required to attach such certifications by proposed <br />subcontractors to his bid, the bidder is hereby advised of this <br />requirement so that appropriate action can be taken to prevent <br />subsequent delay in subcontract awatds. <br />1.2-4 <br />
