DRAFT - MINUTES HAVE NOT BEEN APPROVED BY THE PLANNING COMMISSION <br />Planning Commission Meeting <br />Minutes of July 27, 1999 <br />Page 8 <br />Ms. Banuelos read the staff report stating that the request is for a Major Variance to allow <br />swimming pools in the rear or side yard setbacks in Tract 13362. <br />Public Hearing Opened and Closed without comment <br />Commissioner Chavez questioned whether the City would be liable for defects in the pools if <br />the Major Variance was approved. Mr. Derleth indicated that they would only be approving the <br />location of the pools and that they would not be held responsible for the structural integrity of <br />the pool or the ground it would be placed in. <br />Commissioner Prieto moved approval of File Index Number DV -35-99; seconded by <br />Commissioner Hernandez, motion carried. <br />ITEM G — COMMISSION CONSIDERATION <br />1. FILE INDEX NUMBER: D-36-99 COLCO PROPERTIES, INC. <br />Ms. Banuelos indicated that the request is for a modification of conditions to re -subdivide three <br />lots into two lots. She stated that they are unable to develop the property properly as three <br />lots. She indicated that the applicant has met with the City's Engineer and it has been <br />determined that a lot merger and lot line adjustment would be needed. <br />Vice -Chairperson Vilches moved to approve File Index Number D-36-99; seconded by <br />Commissioner Prieto, motion carried. <br />2. FILE INDEX NUMBER: DS -37-99 MANCHEL & CO. <br />Mr. Soto stated that the request is for a Sign Review to remove three existing wall signs and <br />install three new wall signs at the Denny's located at 1190 South Mount Vernon Avenue. He <br />indicated that Denny's is remodeling all of their restaurants. <br />Commissioner Prieto moved to approve File Index Number DS -37-99; seconded by <br />Commissioner Chavez, motion carried. <br />3. FILE INDEX NUMBER: D-38-99 COBRA EQUIPMENT RENTAL CO. <br />Ms. Banuelos stated that the request is for a Site and Architectural Review for a 4,000 square <br />foot metal building to be located at 224 West Congress. She stated the Commission had <br />previously approved a temporary building and the development of this site. She indicated that <br />at that time an Environmental Study was completed. <br />Vice -Chairperson Vilches moved to approve File Index Number D-38-99; seconded by <br />Commissioner Prieto, motion carried. <br />ITEM H - DIRECTOR'S REMARKS/REVIEW OF CITY COUNCIL AGENDAS <br />Mr. Zamora stated that the Zone Change and General Plan Amendment for Winterton was approved <br />by the City Council. He indicated that the second reading of the Windmill Ordinance was also <br />approved. <br />
