Public Hearing Opened and Closed without comment Commissioner Chavez questioned whether the City would be liable for defects in the pools if the Major Variance was approved. Mr. Derleth indicated that they would only be approving the location of the pools and that they would not be held responsible for the structural integrity of the pool or the ground it would be placed in. Commissioner Prieto moved approval of File Index Number DV -35-99; seconded by Commissioner Hernandez, motion carried. ITEM G — COMMISSION CONSIDERATION 1. FILE INDEX NUMBER: D-36-99 COLCO PROPERTIES, INC. Ms. Banuelos indicated that the request is for a modification of conditions to re -subdivide three lots into two lots. She stated that they are unable to develop the property properly as three lots. She indicated that the applicant has met with the City's Engineer and it has been determined that a lot merger and lot line adjustment would be needed. Vice -Chairperson Vilches moved to approve File Index Number D-36-99; seconded by Commissioner Prieto, motion carried. 2. FILE INDEX NUMBER: DS -37-99 MANCHEL & CO. Mr. Soto stated that the request is for a Sign Review to remove three existing wall signs and install three new wall signs at the Denny's located at 1190 South Mount Vernon Avenue. He indicated that Denny's is remodeling all of their restaurants. Commissioner Prieto moved to approve File Index Number DS -37-99; seconded by Commissioner Chavez, motion carried. 3. FILE INDEX NUMBER: D-38-99 COBRA EQUIPMENT RENTAL CO. Ms. Banuelos stated that the request is for a Site and Architectural Review for a 4,000 square foot metal building to be located at 224 West Congress. She stated the Commission had previously approved a temporary building and the development of this site. She indicated that at that time an Environmental Study was completed. Vice -Chairperson Vilches moved to approve File Index Number D-38-99; seconded by Commissioner Prieto, motion carried. ITEM H - DIRECTOR'S REMARKS/REVIEW OF CITY COUNCIL AGENDAS Mr. Zamora stated that the Zone Change and General Plan Amendment for Winterton was approved by the City Council. He indicated that the second reading of the Windmill Ordinance was also approved.
