File Index Number DCV -33-99 <br />July 13, 1999 <br />Page 4 <br />ENVIRONMENTAL CONCERNS: <br />An Initial Study and Environmental Analysis was prepared by the City Attorney (Best, <br />Best & Krieger), and processed by staff for comments'to the public and all Responsible <br />Agencies, as required by CEQA (California Environmental Quality Act). At the <br />preparation of this report, staff received two responses. The State Department of <br />Transportation (CALTRANS) requested, and a copy was sent, of the Traffic Study that <br />was prepared for the proposed project. The Southern California Gas Company <br />responded to the Initial Study by stating that natural gas facilities are available to serve <br />the proposed facility, and would be available to assist the proposed facility with natural <br />gas service. On July 6, 1999, the Design Review Committee considered the proposed <br />project. The Committee recommends that the Commission approve the Conditions of <br />Approval and the filing of a Mitigated Negative Declaration. Staff concurs with the <br />recommendation from the Design Review Committee. <br />FINDINGS: <br />1. The proposed project is consistent with the intent and guidelines of the General <br />Plan. <br />2. If the Planning Commission grants a Conditional Use Permit and a Major <br />Variance, and the applicant complies with the Conditions of Approval, the <br />proposed project will be consistent with the Zoning Ordinance. <br />3. Special circumstances relating to the location and surroundings of the property <br />warrant a Major Variance from the City's 25% landscaping requirement and from <br />the requirement that industrial buildings in this area consist of masonry block or <br />concrete tilt -up construction. <br />4. The proposed project is compatible with the surrounding uses. <br />5. The proposed project will not have a significant effect on the environment and <br />warrants the adoption and filing of a Mitigated Negative Declaration under CEQA. <br />6. The findings contained in Resolution Number R-03-99 adopting the Mitigated <br />Negative Declaration and a Mitigation Monitoring and Reporting Program are <br />also incorporated herein by reference. <br />RECOMMENDATION: <br />Staff recommends that the Planning Commission approve the following: (1) Resolution <br />Number R-03-99-1 Adopting a Mitigated Negative Declaration and a Mitigation Monitoring <br />and Reporting Program for this Project; (2) Architectural and Site Plan Review; (3) a <br />Conditional Use Permit; and (4) a Major Variance for File Index Number DCV -33-99, <br />subject to the Conditions of Approval. <br />ALS <br />
