R- 76 -99 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, OVERTURNING THE PLANNING COMMISSION <br />DECISION CONCERNING AN ARCHITECTURAL AND SITE <br />PLAN REVIEW, ENVIRONMENTAL DETERMINATION, <br />CONDITIONAL USE PERMIT TO ESTABLISH AND <br />OPERATE A SOLID WASTE COLLECTION, PROCESSING, <br />RECYCLING CENTER AND TRANSLOADING FACILITY, <br />AND A MAJOR VARIANCE TO PERMIT A METAL BUILDING <br />AND TO REDUCE THE REQUIRED 25% LANDSCAPING FOR <br />FILE INDEX NUMBER DCV -33-99 <br />WHEREAS, the Planning Commission of the City of Colton did hold a <br />Public Hearing for File Index Number DCV -33-99 on July 27, 1999, to consider <br />the applicant's request for an Architectural and Site Plan Review, <br />Environmental Determination, Conditional Use Permit to establish and operate <br />a solid waste collection, processing, recycling center and transloading facility, <br />and a Major Variance to permit a metal building and to reduce the required <br />25% landscaping; and <br />WHEREAS, the Planning Commission approved the remainder of DCV - <br />33 -99, it did deny the Major Variance to permit a metal building ("Appealed <br />Decision"); and <br />WHEREAS, the Planning Commission approved the remainder of File <br />Index Number DCV -33-99 other than the Appealed Decision; and <br />WHEREAS, the applicant has appealed said Appealed Decision within <br />the required time frame; and <br />WHEREAS, the City Council finds that the appeal is justified, based on <br />the information provided, including all written and oral evidence in the record. <br />
