MR 13. 1999. After an altercation inside the Club, a disgruntled patron shot <br />the manager of the Club while leaving the premises in his vehicle. The <br />customer was apprehended shortly thereafter by the Colton PoliceDepartment. <br />Four counts of attempted murder charges are pending. (Based Agenda Report, <br />Exhibit 2E, Stipulation by Attorney Diamond) <br />B. Sufficient evidence exists to find and determine that the Rocks Club has been <br />conducted in an illegal, unproper or disorderly manner. The City Council granted approval of the <br />Dance Permit on April 6, 1999. The City Council's approval of the Dance Permit was subject to <br />certain conditions of approval. (Based on Exhibit 2B) The conditions of approval were imposed <br />pursuant to Calton Municipal Code Section 5.32.050 and were based upon, and in response to, the <br />City Council's concerns about unlawfid activity occurring at other dance clubs owned by the <br />Applicants in other cities. (Based on Exhibit 2H and Testimony of Sgt. drDianous) The conditions <br />imposed on the Dance Permit were agreed to, in writing, by the Applicant. (Based on Exhibits 2A, 2C <br />& 2D). The anal and written testimony introduced at the hearing demonstrates, by a preponderance <br />ofthe evidence; that the Rocks Club has been conducted in an illegal, improper and disorderly manor. <br />Further the City Council finds and determines that operation of the Rocks Club as a dance hall <br />constitutes it threat to the public safety of the citizens of Colton. This oral and written testimony <br />included: <br />1. In accordance with the conditions ofapproval, the Rocks Club was required to <br />provide the Chief of Police with a list of all guards which may be assigned for <br />that month. Lists were not provided for the months of April or May until after <br />these revocation proceedings were initiated. (Based on Agenda Report, Exhibit <br />2D and Testimony of Chief Crowe) <br />3. In accordance with the conditions of approval, the Rocks Club agreed to <br />reimburse the.City for a portion of the administrative costs incurred in <br />monitoring the guards and for occasional visits to check on required security <br />conditions. Further, the Rocks Chili agreed to make payments each month on <br />the anniversary of the Club's opening date. While the testimony established <br />that there was sume confusion as to the opening date of the Rocks Club, only <br />3 <br />
