Report to Agency Board re Mt. Vernon Corridor Project 2\33445 Finding <br />April 4, 2000 <br />Page 2 of 6 <br />The projects recommended for funding by the Citizens Committee are identified on a map of the <br />project area, attached to the staff report as Exhibit "B". Most of the projects will take place <br />within the project area boundaries; however, several of the residential improvement projects <br />may be located outside of the boundaries of the project area. These projects are identified and <br />denoted by an asterisk above. Generally, redevelopment funds must be spent within the Project <br />Area; however, redevelopment funds may be spent outside of the project area if the projects <br />can be found to benefit the project area or the neighborhoods surrounding the project area. <br />At the January 18, 2000 meeting of the Agency, the Agency Board approved the list of public <br />improvement projects recommended for funding by the Mt. Vernon Citizens Advisory <br />Committee, and forwarded the list of projects for review and necessary actions by the Planning <br />Commission and City Council. Prior to the Agency's final approval of the projects and <br />authorization of the expenditure of tax increment funds for the installation or construction of <br />these public improvements, the Planning Commission must find that the proposed public <br />improvement projects are consistent with the General Plan (Government Code Section 65401 <br />and 65402); and, the City Council must make certain findings and authorize the use of <br />Redevelopment funds for the construction of public improvements pursuant to Health and <br />Safety Code Section 33445. <br />On March 14, 2000, the proposed public improvement projects for the Mt. Vernon Project Area <br />were presented to the Planning Commission for their review and consideration. At that meeting, <br />the Planning Commission made the necessary findings that the list of Public Improvement <br />Projects was consistent with the City's General Plan and adopted Resolution No. 0-2-00. A <br />copy of a report of these finding made by the Planning Commission is attached to the staff <br />report as Exhibit "C". <br />Discussion <br />The next step, prior to the Agency taking its action to appropriate the funds necessary to install <br />or construct the aforementioned projects, is for the City Council to make certain findings and <br />approve the use of Agency funds to pay for all or part of the value of the land and public right-of- <br />way and the cost of the installation and construction of any of the public improvement projects <br />pursuant to Health and Safety Code Section 33445. <br />The City Council must make the following findings: <br />1) That the building, facility, or other improvements are of benefit to the project area or the <br />immediate neighborhood in which the project is located. <br />2) That no other reasonable means of financing the buildings, facilities, or other improvements <br />are available to the community. <br />3) The payment of funds for the acquisition of land or the cost of buildings, facilities, <br />structures, or other improvements, will assist in the elimination of one or more blighting <br />conditions inside the project area, provide housing for low- or moderate -income persons, <br />and is consistent with the implementation plan. <br />
