The projects recommended for funding by the Citizens Committee are identified on a map of the <br />project area, attached to the staff report as Exhibit °B". As can be seen by the map, several of <br />the projects are located outside the boundaries of the project area. These projects are identified <br />above and denoted by an asterisk. Generally, redevelopment funds must be spent within the <br />Project Area; however, redevelopment funds can be spent outside of the project area if the <br />projects can be found to benefit the project area. <br />At the December 7, 1999 meeting of the Agency, the Agency Board approved considering the <br />list of public improvement projects recommended for funding by the Santa Ana River Citizens <br />Advisory Committee and forwarded the list of approved public improvement projects for review <br />and necessary actions by the Planning Commission and City Council. Prior to the Agency's <br />final approval of the projects and authorization of the expenditure of tax increment funds for the <br />installation or construction of these public improvements, the Planning Commission must find <br />that the proposed public improvement projects are consistent with the General Plan pursuant to <br />Government Code Section 65401; and, the City Council must make certain findings and <br />authorize the use of Redevelopment funds for the construction of public improvements pursuant <br />to Health and Safety Code Section 33445. <br />Section 33445 of the Health and Safety Code, provides the authority for the agency to pay, with <br />the consent of the legislative body, for all or part of the land for and the cost of installing and <br />construction of any building, facility, structure, or other improvement which is publicly owned <br />either within or outside of the project area, if the legislative body determines that the <br />improvements will benefit the project area, there is no other reasonable means to finance the <br />improvements, and the improvements will eliminate blight. <br />On January 25, 2000, the proposed public improvement projects for the Santa Ana River Project <br />Area were presented to the Planning Commission for their review and consideration. At the <br />meeting, the Planning Commission made the findings that the lists of Public Improvement <br />Projects were consistent with the City's General Plan and adopted Resolution No. 0-1-00. A <br />copy of a report of these finding made by the Planning Commission is attached to the staff <br />report as Exhibit "C". <br />Discussion <br />The next step that is necessary prior to the Agency taking its action to appropriate the funds <br />necessary to install or construct the aforementioned projects, is for the City Council to make <br />certain findings and approve the use of Agency funds to pay for all or part of the value of the <br />land and public right-of-way and the cost of the installation and construction of any of the public <br />improvement projects pursuant to Health and Safety Code Section 33445. <br />The City Council must make the following findings: <br />1) That the building, facility, or other improvements are of benefit to the project area or the <br />immediate neighborhood in which the project is located. <br />2) That no other reasonable means of financing the buildings, facilities, or other improvements <br />are available to the community. <br />3) The payment of funds for the acquisition of land or the cost of buildings, facilities, <br />structures, or other improvements, will assist in the elimination of one or more blighting <br />conditions inside the project area, provide housing for low- or moderate-income persons, <br />and is consistent with the implementation plan. <br />
