In that capacity we are in receipt <br />of your claim for damages when a tree branch fell onto your vehicle during heavy wind <br />conditions. <br />The heavy wind conditions were not the fault of the City of Colton. There was no <br />previous problems with this tree or the branch; the wind was the cause of the branch <br />falling. With this in mind we find there is no liability on the part of the City of Colton. <br />With the above in mind, we have recommended denial of your claim.
