Section 5. Except as otherwise set forth in this Resolution, the facts and conclusions <br />set forth in the Final EIR are incorporated into this Resolution by this reference, as the findings <br />of fact and conclusions of the Agency regarding the potential environmental impacts of the <br />Redevelopment Plan. <br />Section 6. The Agency also adopts the Mitigation Monitoring Program ("MMP") in <br />the Final EIR and conditions its approval of the Redevelopment Plan on the effective <br />implementation of the mitigation measures set forth in such MMP. The City of Colton, as the <br />public agency with general land use jurisdiction over the lands within the geographic area <br />affected by the Redevelopment Plan, shall be primarily responsible for requiring and monitoring <br />compliance with any applicable mitigation measures set forth in the MMP. The Agency does not <br />have concurrent land use jurisdiction with the City to impose or monitor the implementation of <br />the mitigation measures set forth in the MMP. To the extent that the Agency can require <br />compliance with any applicable mitigation measures set forth in the Final FIR by contract, it will <br />do so. <br />Section 7. Geology. The Final FIR addresses potential impacts of the <br />Redevelopment Plan on geology, at pages 14 through 18. The Final EIR concludes that <br />significant impacts on geology could be associated with construction of public or private projects <br />in furtherance of the Redevelopment Plan. The Agency finds and determines that the <br />recommended geological impact mitigation measures set forth on pages 17 and 18 of the Final <br />FIR will mitigate the potential geological impacts that could be associated with construction of <br />public or private projects in furtherance of the Redevelopment Plan to a less than significant <br />level, <br />Section 8. Biological Resources. The Final EIR addresses potential impacts of the <br />Redevelopment Plan on biological resources, at pages 19 through 33. The Final EIR concludes <br />that significant impacts on biological resources could be associated with construction of public <br />or private projects in furtherance of the Redevelopment Plan. The Agency finds and determines <br />that the recommended mitigation measures set forth on pages 32 and 33 of the Final EIR will <br />mitigate the potential impacts on biological resources that could be associated with construction <br />48 16-6214-9632,1 <br />
