Report to City Council and Redevelopment Agency Board regarding Health and Safety Code 33445 for SAR Additional Projects Page 3 of 5 (vi) Traffic Signal Modification Total Available: $101,800 other funds used $ 607,770 The City Engineer is recommending three additional projects be considered for funding utilizing the remaining funds available. The three new projects identified include drainage and/or street reconstruction at the locations listed below: # Nomenclature Estimated Cost (viii) Road Reconstruction of Cooley Ranch Wood Street Subdivision $ 312,000 (ix) Road Reconstruction of Cooley Drive from 1-215 to Cooley Lane $ 189,000 (x) Road Reconstruction of Old Ranch Road $80,000 Total Estimated Costs: $ 581,000 DISCUSSION/ANALYSIS Prior to the Agency's final approval of the projects and authorization of the expenditure of tax increment funds for the installation or construction of these public improvements, the City Council must make certain findings and authorize the use of Redevelopment funds for the construction of public improvements pursuant to Health and Safety Code Section 33445. Section 33445 of the Health and Safety Code, provides the authority for the agency to pay, with the consent of the legislative body, for all or part of the land for and the cost of installing and construction of any building, facility, structure, or other improvement which is publicly owned either within or outside of the project area, if the legislative body makes the following findings: 1) That the building, facility, or other improvements are of benefit to the project area or the immediate neighborhood in which the project is located. 2) That no other reasonable means of financing the buildings, facilities, or other improvements are available to the community. 3) The payment of funds for the acquisition of land or the cost of buildings, facilities, structures, or other improvements, will assist in the elimination of one or more blighting conditions inside the project area, provide housing for low- or moderate -income persons, and is consistent with the implementation plan. All three of the projects recommended for funding are located within the project area. - Road Reconstruction of Cooley Ranch Wood Street Subdivision - Road Reconstruction of Cooley Drive from 1-215 to Cooley Lane - Road Reconstruction of Old Ranch Road Section 33445 - Benefit Findings: • The Road Reconstruction of Cooley Ranch Wood Street Subdivision can be shown to benefit the Project Area and surrounding neighborhood as follows: The Road Reconstruction of Cooley Ranch Wood Street Subdivision will enhance the visual aesthetics of the area, improve safety, will serve as an element of community design and provide needed pedestrian improvements that are lacking in the area. These streets are presently in a substandard condition and pose an obstruction to efficient traffic movement; construction of RAShamRDA\Meetingst2004 Meetings\Mamh 2, 2004\SAR 33445 staff repon.dm
