4 MAYOR'S REPORTS AND PROCLAMATIONS: <br />Proclamations <br />Mayor Gonzales read three Proclamations in Full, declaring May as High Blood <br />Pressure Month and Correct Posture Month, and May 10 through 16 as Small Busi- <br />ness Week in Colton. <br />PUBLIC HEARINGS: <br />Ordinance No. 1585 <br />South Colton Industrial Moratorium <br />Mayor Gonzales declared the public hearing open. <br />City Attorney Edwards submitted the Affidavit of Publication and reported that he <br />had received a letter tonight from the Interinsurance Exchange of the Automobile <br />Club of Southern California on behalf of Mr. Ed Carroll, owner of Country Club <br />Storage, 1203 S. Rancho. <br />Mr. Edwards said Ordinance No. 1585 placed a moratorium on industrial land uses <br />in the southern portion of Colton pending studies. Atorney Edwards said the <br />ordinance is due to expire June 17, 1981, the studies are in progress; however, <br />they are not complete. Mr. Edwards continued by saying the ordinance may be ex- <br />tended one more time only and then not more than one year and staff through this <br />required public hearing, is recommending the one year extension to Ordinance No. <br />1585. <br />Mr. Ed Carroll addressed the City Council and submitted two letters, one from Ross <br />& Stein representing Marquardt Land Company, and one from MD Enterprises Inc., <br />Specialists in Equestrian Housing; both letters were offers to purchase Mr. Carroll's <br />property at Rancho and La Cadena. Mr. Carroll stated that he has been negotiating <br />these offers fro some two years and he feels it totally unfair for the moratorium <br />to be extended. The extension would financially hurt him and the City. Mr. Carroll <br />felt he should be allowed to expand and improve his facility, as he was led to be- <br />lieve his would be a permitted use at the time of purchase. <br />Mr. Carroll closed by saying that his property sits next to the Water Quality Con- <br />trol Plan and a Batch Plant both of which emit nuisance odors and this area would <br />not appear best suited for residential; therefore, he felt the City in all fair- <br />ness, should allow him to improve his property for his continued use or make it <br />possible for him to sell his property. <br />Mrs. Lorenza Vasquez, 677 South 8th Street, stated that although she was not pre- <br />pared to speak on the subject tonight, she did not feel the moratorium should be <br />extended to allow for the completion of the studies and that Ordinance No. 1600 <br />should be passed as it was the impression of the residents in the area that the <br />additional described area had been intended to be in the moratorium area. <br />Mr. A. Moreno stated that the extension was needed pending the completion of the <br />General Plan Study. <br />Nicky Zafuto said they currently own a home in the moratorium area, and the <br />moratorium really presents problems with regard to selling your home or improv- <br />ing the area. Mrs. Zafuto says she understands about the General Plan Study, <br />however, in the meantime what about their properties. <br />Councilman Hayes stated that tonight was the first that he had seen of the material <br />submitted by Mr. Ed Carroll and as far as he was concerned there are two sides to <br />the problem. Councilman Hayes asked for a continuance. <br />Moved by Councilman Hayes, seconded by Councilman Rehrer, to continue the public <br />hearing to May 19, 1981. Unanimous vote. <br />PLANNING COMMISSION REPORTS AND RECOMMENDATIONS: <br />Conditional Use Permit <br />P. C. Res. No. 995 <br />Planning Director Aguilera reported this item concerns an application for develop- <br />ment of twenty-three (23) lot single family subdivision on 6.75 + acres. <br />Mr. Aguilera stated the Planning Commission held a public hearing and recommends <br />approval of Tentative Tract No. 11895. <br />Moved by Councilwoman Garcia, seconded by Councilman Rehrer, to approve Planning Com- <br />mission Resolution No. 995, Hezmalhalch Development⢠Unanimous vote. <br />MAY 6 1981 <br />
