Planning Director Aguilera advised that this matter was brought to Staff's attention <br />1 8 when a complaint had been followed-up with regard to the church services being held <br />at the recreation hall in the mobile home park. Mr. Aguilera said the Ordinance <br />states that in order to have religious assembly of two or more persons, a Conditional <br />Use Permit must be obtained. Mr. Aguilera said the Planning Commission held a Public <br />Hearing on this matter and also had outside legal counsel from Mrs. Thornton on how <br />this matter should be handled. <br />Councilman Rehrer said he understands that the recreation building already has a <br />Conditional Use Permit for public assembly, and inasmuch as our Constitution guaran- <br />tees freedom of speech and freedom of assembly and religion, he felt this was a civil <br />matter and the City should not get involved. Mr. Rehrer felt that the City should <br />review the existing Ordinance. <br />Councilman Rios stated he felt this is a matter that should be decided by the Courts, <br />let them make a decision on what should be done. <br />Councilwoman Cisneros said this is a very touchy situation and she agreed with Council- <br />man Rehrer. Mrs. Cisneros felt this matter could be handled "in house". Mrs. Cisneros <br />said she also agreed that the City should review the existing Ordinance. <br />Councilwoman Garcia said she felt that the City cannot pick one over the other, and <br />say that one should have a Conditional Use Permit and the other should not. Mrs. <br />Garcia felt the Council should deal with this matter, and listen to the recommenda- <br />tions from the Planning Commission. <br />Discussion then followed among Council Members, Pastor Minkler and Staff with regard <br />to the church's services, the existing Ordinance, and discussions at Planning Com- <br />mission meetings. <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, that any action on <br />this matter concerning the Valley Community Church be postponed until Staff has an <br />opportunity to review the existing Ordinance, and that Staff take no action on the <br />Cease and Desist Order. Motion carried, with Councilwoman Garcia voting NO. <br />Councilman Rios asked about the time frame on this matter, and how long a period <br />are we talking about. <br />Councilman Rehrer stated until the next regular Council Meeting scheduled for -^ <br />May 4, 1982. <br />Mrs. Phyllis Brooks, resident of Lake Cadena Mobile Home Park, spoke to the City <br />Council opposing the religious services being conducted by the Valley Community <br />Church, stating that this was no place to hold this kind of activity, and she felt <br />the City Council should do something about it. <br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Bids <br />Weed Abatement <br />City Engineer, Ben Urguiza, advised that the re -bids on the 1982 Weed Abatement <br />Program were opened on April 19, 1982, with three bids being received, and Staff <br />recommends the award be made to the lowest bidder, Rick's Tractor and Discing, in <br />the amount of $15,609.28. <br />Moved by Councilman Rehrer, seconded by Councilwoman Garcia, approving award of bid <br />for 1982 Weed Abatement Program to Rick's Tractor and Discing in the amount of <br />$15,609.28. Unanimous vote. <br />Water Division <br />Mr. Urguiza said that Staff requests permission to advertise for bids on the repair <br />of the City's three million gallon concrete water reservoir, as recommended by <br />Willdan & Associates, the engineering firm contracted to inspect and determine the <br />necessary repairs of the tank. <br />Moved by Councilman Rehrer, seconded by Councilwoman Garcia, approving and authorizing <br />Staff to advertise for bids for the repair of the City's three million gallon concrete <br />water reservoir. Unanimous vote. <br />Parcel Maps <br />Mr. Urguiza recommended acceptance of an offer of dedication of an additional five <br />feet of property for public right-of-way purposes for Parcel Map No. 7220, located <br />south of Mill Street, on the west side of Rancho Avenue. <br />APR 2 0 1982 <br />
