Mr. McGee advised that the consulting engineers, Krieger and Stewart, proposed three
<br />2 4 (pdditional changes to the contract, and these changes were verbally accepted by the
<br />then City Manager, Robert Trevino, and the Council, at that time, were aware of these
<br />changes. Equinox Malibu completed the required changes, however, no change orders
<br />were presented for Council approval. Mr. McGee referred to a letter from Krieger and
<br />Stewart explaining each change order.
<br />Mr. McGee concluded if Council concurs, Staff would recommend acceptance of Change
<br />Orders Nos. 9, 10 and 11.
<br />Councilman Rios said he was wondering why there is an amount of $50,000 in change
<br />orders.
<br />Mr. McGee answered a good portion of these changes were amounts added to Equinox
<br />Malibu's contract for installation and deducted from the Gray Engineering contract.
<br />Mr. McGee said that Change Orders Nos. 1. through 8 have previously been accepted
<br />by the Council, and Change Orders Nos. 9, 10 and 11 amount to approximately $6,500,
<br />and from this amount approximately $1,200 will be charged against the Gray Engineer-
<br />ing group.
<br />Councilman Rios asked if the consultants, Krieger and Stewart, had made inspections
<br />at the plant prior to this, as he found it hard to believe that all of a sudden
<br />there are so many items that should have been taken care of, and work that needs
<br />to be done, in order to make the plant function properly.
<br />Mr. Robert Krieger, of Krieger and Strewart, advised there have been 11 change orders
<br />submitted on this project, amounting to approximately $50,000, and $25,000 of this
<br />will be charged to Gray Engineering for defective materials furnished on the job.
<br />Mr. Krieger then spoke about the plant renovation, modification of the existing
<br />plant, stating the original plant was constructed some years back and the second
<br />unit was constructed in 1974, and there were a number of change orders that addressed
<br />removal and replacement or relocation of some of the existing facility, also requests
<br />from the Regional Water Quality Control Board that had to be met, and other changes
<br />or requirements that were needed. Mr. Krieger stated he would go through each of
<br />the change orders as listed in their letter dated July 28, 1982, if the Council so
<br />desired.
<br />Mayor Huntoon asked if Equinox Malibu has completed their portion of the contract, anti --
<br />was any of the equipment that they installed part of the Gray Engineering equipment
<br />and will that have to be replaced.
<br />Mr. Krieger answered that Equinox Malibu has completed their part of the contract,
<br />their work, and they installed all of the equipment that was furnished by Gray Engi-
<br />neering.
<br />Discussion then followed with regard to the equipment that had been installed, and
<br />the defective equipment that will be replaced, and reinstallation.
<br />Mayor Huntoon then asked Mr. Krieger when he guessed would be the completion date
<br />on this project, as it is approximately one year late, and the Council and people
<br />are concerned about this.
<br />Mr. Krieger stated the plant is essentially complete, all of the work is complete,
<br />it is now treating the sewage adequately but not doing it as efficiently as it
<br />should, however, with removal and replacement of the defusers, we are looking for
<br />a completion date of November 20, 1982.
<br />After additional discussion, moved by Councilwoman Garcia, seconded by Councilman
<br />Rehrer, approving Change Orders Nos. 9, 10 and 11 for the Wastewater Treatment Plant
<br />Renovation as outlined. Unanimous vote.
<br />Wastewater Treatment Plant
<br />Mr. McGee reported all phases of the construction contract awarded by the City
<br />Council on June 16, 1982, to Equinox Malibu for the Water Quality Control Plant
<br />Renovation has been 100% completed.
<br />Mr. McGee said Staff recommends acceptance of the Contract as 100% completed and
<br />authorize filing the Notice of Completion on this project.
<br />Moved by Councilwoman Cisneros, seconded by Councilman Rios, approving Staff's
<br />recommendation with regard to construction installation for the Wastewater Treat-
<br />ment Plant Renovation by Equinox Malibu. Unanimous vote.
