Mr. Elliott continued the life of the plan is forty years. The Agency shall have a <br />2 70 maximum of 15 years to incur project indebtedness, with an additional twenty-five <br />years to retire debt. The maximum bonded indebtedness secured by tax increment for <br />this project shall not exceed $16,400,000 outstanding at one time, and the Agency <br />shall not receive more than $60 million in tax increment for this Project. <br />Mayor Huntoon then asked for a summary of the final Environmental Impact Report. <br />Mr. Manuel Nunes, of Patterson & Nunes, stated that their firm, with the collabora- <br />tion of the Staff and fellow consultants engaged by the Agency, undertook the assign- <br />ment of preparing the Santa Ana River Redevelopment Project Environmental Impact Re- <br />port, and it was prepared to comply with the California Environmental Quality Act and <br />follows all C.E.Q.A. guidelines. <br />Mr. Nunes advised that all legal procedures have been followed, affected agencies coi <br />tacted, and relevant material made available for public review, and all comments and <br />responses have been dutifully recorded and are included in the Council's and Agency': <br />packets. <br />Mr. Nunes continued the purpose of the E.I.R. is to analyze the physical, social, <br />environmental and economic impacts and issues which may stem from the adoption and <br />implementation of the proposed Redevelopment Plan. This document is not intended to <br />provide recommendations as to whether or not the Project should be approved, but only <br />to supply information and analysis to enable appropriate public bodies and concerned <br />indivuduals to evaluate the environmental effects of the proposed plan. <br />Mr. Nunes stated after public hearings, and on May 11, 1982, the Planning Commission <br />recommended approval of the Santa Ana River Redevelopment Project draft E.I.R. as <br />being a fully comprehensive and complete report. <br />Mr. Nunes concluded it is hopeful that the Council and Agency will certify the E.I.R. <br />as presented and as recommended. <br />Mayor Huntoon then asked the City Clerk to read any written communications received <br />regarding the proposed Redevelopment Plan since the Continued Public Hearing. <br />City Clerk Ramos read portions of a letter dated December 21, 1982, from James W. <br />Dilworth, Attorney, on behalf of the San Bernardino Valley Municipal Water District, <br />stating representatives of the district have been informally advised the City of <br />Colton contemplates that the Redevelopment Plan will provide for a "pass-through" or <br />refund of amounts equivalent to incremental tax revenues to the San Bernardino Valle <br />Water District and will enter into an agreement with the district to that effect. Ii <br />the event such is done, the district would not be adversely affected by the project <br />and accordingly would have no objection to it and, in such event, it is requested <br />that this statement be considered as withdrawn by the district. In the absence of <br />such action, the district wishes to submit its objections to the plan upon the basis <br />set forth in the letter. <br />Mr. John Brown, Agency Counsel, advised there have been several meetings held with <br />representatives of the Water District, including the Attorney, Mr. Dilworth, regard- <br />ing a proposed Agreement that would provide for the kind of arrangement as outlined <br />in their letter. Mr. Brown stated, as the Agency Counsel, he is prepared to recom- <br />mend such an Agreement to the Council and Agency this evening, and can briefly sum- <br />marize the proposed Agreement if so desired by the Council and Agency. <br />Mayor Huntoon then asked that all those wishing to speak regarding the Redevelopment <br />Agency Plan please state their name and address, and comment directly to the Redevelop- <br />ment Plan. <br />Speaking in favor of the Redevelopment Plan for the Santa Ana River Redevelopment <br />Project were the following: <br />Mr. Robert Rich, Director of Administrative Services, Colton Joint Unified School <br />District. <br />Mr. Edward Levine, of the Southern Pacific Industrial Development Company. <br />Mr. David Graff, of Fredericks Development Company. <br />Mr. Earl Young, representing Pacific Coast Builders. <br />Mr. Gene Fuller, of Broadmoor Homes, Inc. <br />Speaking in opposition to the Redevelopment Plan for the Santa Ana River Redevelop- <br />ment Project were the following: <br />Mr. William Katz, part owner of a parcel of land within the Redevelopment Plan, stating <br />he felt the City, or whatever public entity involved, should bear the expense or rede- <br />signing the intersection of Barton Road, Hunts Lane and Reche Canyon Road, which is <br />badly needed; he did not feel it was necessary to split up a certain parcel of land <br />into three smaller parcels, pointing out the property involved; and he did not feel <br />it was right that any of the property owners within the Redevelopment Plan area should <br />mo <br />
