have to pay the expense of realigning intersections or improvement of roads in the <br />Project Area. 271 <br />Mayor Huntoon asked if anyone desired to speak on the Environmental Impact Report. <br />Mayor Huntoon stated that before he closed the Public Hearing he would like to ask <br />Staff to make a brief presentation. <br />Mr. John Brown stated he would make his comments brief, however, he would like to <br />respond to comments made by Mr. Katz, and that is in the opinion of Staff, consult- <br />ants, and all those working on this Project for the last year, the Santa Ana River <br />Redevelopment Project makes sense because it is in the best interests of the citizens <br />and taxpayers of Colton, this Project will not cost Mr. Katz, or any other land owner <br />within the Project, an additional dime in real property taxes because that is not the <br />way Redevelopment works, and Mr. Katz, or any other property owners within the Project <br />area, will not be expected to pay through a special tax or assessment or special <br />charge for the costs of the improvements to be constructed, this is a part of the <br />Redevelopment Project effort. <br />Mr. Brown then spoke about the possibility of future realignment of the intersection <br />of Barton Road, Hunts Lane and Reche Canyon Road, and that at some future time the <br />Council and Agency may act upon this matter. Mr. Brown stated that nothing before <br />the Council and Agency this evening in any way affects the division of Mr. Katz's <br />property. Mr. Brown advised that with the passing of Proposition 13 and Proposition <br />4, it is no longer possible for the City Council or the Redevelopment Agency to in <br />N any way increase the ad valorem taxes of this Project area without a vote of the <br />N people, and no such vote is proposed or contemplated in connection with this Project <br />and, in fact, the monies to be used to fund the Project are expected to come out of <br />tax increment, that is to say additional real property taxes generated by increases <br />Q in assessed value which otherwise would have gone to the County of San Bernardino, <br />Q the San Bernardino Valley Municipal Water District, the Colton Joint Unified School <br />District, and a number of other affected taxing entities. <br />Mr. Brown then advised that Staff has worked very hard in meeting with the taxing <br />entities affected within the Project Area, and have submitted to these agencies a <br />Cooperation Agreement, with the exception of the Community College District who <br />have indicated they will be getting back with Staff in January, and Staff has now <br />reached actual cooperation contractual obligation agreements between the affected <br />taxing entities and the Redevelopment Agency. Mr. Brown said Staff expects that <br />if the Council and Agency elect to proceed with the approval of the Project this <br />evening, to have those agreements in a position where they could be ratified by <br />the Council and Agency in the coming weeks as a part of the post Redevelopment <br />adoption process. Mr. Brown pointed out there is a sixty day challenge statute <br />under the California Comr7unity Redevelopment Law, which offers an opportunity in <br />the event there is not a successful resolution. <br />Mayor Huntoon then declared the City Council Public Hearing closed. <br />Chairperson Garcia then declared the Redevelopment Agency Public Hearing closed. <br />Mr. Brown then discussed and presented the resolutions for consideration and approval <br />by the Redevelopment Agency. <br />Moved by Member Huntoon, seconded by Member Rios, to approve Redevelopment Agency <br />Resolution No. 369. Unanimous vote. <br />RESOLUTION NO. 369 - RESOLUTION OF THE REDEVELOPMENT AGENCY FOR THE CITY OF COLTON <br />FINDING AND DECLARING THAT THE PROVISION OF LOW AND MODERATE <br />INCOME HOUSING OUTSIDE THE SANTA ANA RIVER REDEVELOPMENT PROJECT <br />AREA IS OF BENEFIT TO THE PROJECT AREA. <br />Moved by Member Huntoon, seconded by Member Rehrer, to approve Redevelopment Agency <br />Resolution No. 370. Unanimous vote. <br />RESOLUTION NO. 370 - RESOLUTION OF THE REDEVELOPMENT AGENCY FOR THE CITY OF COLTON <br />CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE <br />SANTA ANA RIVER REDEVELOPMENT PROJECT. <br />Moved by Member Huntoon, seconded by Member Rehrer, to approve Redevelopment Agency <br />Resolution No. 371. Unanimous vote. <br />RESOLUTION NO. 371 - RESOLUTION OF THE REDEVELOPMENT AGENCY FOR THE CITY OF COLTON <br />APPROVING THE PROPOSED REDEVELOPMENT PLAN FOR THE SANTA ANA <br />RIVER REDEVELOPMENT PROJECT AND RECOMMENDING ADOPTION OF SAID <br />REDEVELOPMENT PLAN BY THE CITY COUNCIL OF THE CITY OF COLTON. <br />DEC 2 1 1982 <br />
