Moved by Councilwoman Garcia, seconded by Councilman Hayes, to waive full reading] 5(
and pass First Reading of Ordinance No. 1615. Unanimous vote.
ORDINANCE NO. 1615 - AN ORDINANCE OF THE CITY OF COLTON AMENDING ORDINANCE NO. 1602,
First Reading AS AMENDED, AND PROVIDING FOR CERTAIN ZONE RECLASSIFICATIONS.
Appeals
P. C. Res. No. 1018
Mayor Gonzales declared the Public Hearing open.
City Clerk Ramos submitted the Affidavit of Publication and reported that a letter
of protest had been received from Jesus N. Vasquez.
City Manager Trevino reported that the applicant, Hugo Neu-Proler, has requested a
Conditional Use Permit to construct and operate a new business to sell used auto
parts from damaged cars. The used automobile parts yard project will include the
construction of a small office building, storage facilities, and customer parking,
together with landscaping and wall improvements, however, no expansion of the
present salvage operation is proposed.
Mr. Trevino continued the Planning Staff determined that a full Environmental Im-
pact Report would be required and the applicant was instructed to submit a full
EIR with the appropriate mitigating measures. The Planning Staff then determined
N that the proposed project is consistent with the base zoning and the General Plan,
it will be compatible with the surrounding uses if the proposed site plan is im-
plemented in order to provide a buffer to the residential development to the west,
7 and it will be compatible to its surrounding environs when the proposed mitigating
Q measures have been taken.
Q Mr. Trevino said that Staff recommends approval of the Conditional Use Permit appli-
cation subject to 27 conditions, as outlined in Exhibit "A" of Resolution No. 4183.
Mr. Trevino stated that on January 12, 1982, the EI
ditional Use Permit, and the Environmental Impact Report was approved by the Planning
Commission, however, the Conditional Use Permit application was denied; hence, the
reason for the Appeal this evening.
Mr. Trevino said Staff recommends approval of this Appeal, and the CUP, in order to
develop a substantially blighted area to its highest and best use.
Mr. Trevino then referred to drawings of the area involved, indicating the surround-
ing zoning and uses, and the proposed project, advising the applicant proposes to
develop future industrial lots adjacent to his business, improve the dedicated por-
tion of Lytle Creek Channel with concrete, and the development of dedicated streets.
Mr. Trevino reported that area to the west will be down -zoned to R-3 which will serve
as a buffer to adjacent properties. Mr. Trevino concluded the proposed project will
create approximately $28,000 in taxes for the City, approximately 40 to 50 new jobs,
and will develop this area to its highest and best use.
Mayor Gonzales asked if anyone present desired to speak in favor of or in opposition
to this matter.
The following persons spoke in opposition to the proposed project, stating there was
no need for another "junk yard" in South Colton, the business would create too much
additional traffic along "M" Street and La Cadena Drive, the possible contamination
of the City's drinking water supply by the uncontrolled dumping of vehicle fluids on
the site and fire risk by storing and handling of lubricants and fuels, and the
proposed business was not the "highest and best use" for the area.
Mr. Jess Vasquez, 296 East M Street, Colton.
Ms. Millie Herrera, 249 East N Street, Colton.
Ms. Marina Vidaurri, 1150 Grand Avenue, Colton.
Mrs. Bea Hernandez, 258 East N Street, Colton.
Mr. Joe Moreno, 470 West M Street, Colton.
Speaking in favor of the proposed project were the following:
Ms. Lorenza Vasquez, 677 South 8th Street, Colton.
Miss Rosemary Colunga, 545 West 0 Street, Colton.
Mr. Ron Gemmel, representing the Colton Fire Department, referred to a committee that
had studied possible locations for fire stations in Colton, advising that the property
in question this evening was one of the sites selected as a good place for a fire
station.
FEB iG1984
