<br />ORDINANCE NO. 1615 - AN ORDINANCE OF THE CITY OF COLTON AMENDING ORDINANCE NO. 1602,
<br />First Reading AS AMENDED, AND PROVIDING FOR CERTAIN ZONE RECLASSIFICATIONS.

<br />Mayor Gonzales declared the Public Hearing open.
<br />City Clerk Ramos submitted the Affidavit of Publication and reported that a letter
<br />of protest had been received from Jesus N. Vasquez.
<br />City Manager Trevino reported that the applicant, Hugo Neu-Proler, has requested a
<br />Conditional Use Permit to construct and operate a new business to sell used auto
<br />parts from damaged cars. The used automobile parts yard project will include the
<br />construction of a small office building, storage facilities, and customer parking,
<br />together with landscaping and wall improvements, however, no expansion of the
<br />present salvage operation is proposed.
<br />Mr. Trevino continued the Planning Staff determined that a full Environmental Im-
<br />pact Report would be required and the applicant was instructed to submit a full
<br />EIR with the appropriate mitigating measures. The Planning Staff then determined
<br />N that the proposed project is consistent with the base zoning and the General Plan,
<br />it will be compatible with the surrounding uses if the proposed site plan is im-
<br />plemented in order to provide a buffer to the residential development to the west,
<br />7 and it will be compatible to its surrounding environs when the proposed mitigating
<br />Q measures have been taken.
<br />Q Mr. Trevino said that Staff recommends approval of the Conditional Use Permit appli-
<br />cation subject to 27 conditions, as outlined in Exhibit "A" of Resolution No. 4183.
<br />Mr. Trevino stated that on January 12, 1982, the EI
<br />ditional Use Permit, and the Environmental Impact Report was approved by the Planning
<br />Commission, however, the Conditional Use Permit application was denied; hence, the
<br />reason for the Appeal this evening.
<br />Mr. Trevino said Staff recommends approval of this Appeal, and the CUP, in order to
<br />develop a substantially blighted area to its highest and best use.
<br />Mr. Trevino then referred to drawings of the area involved, indicating the surround-
<br />ing zoning and uses, and the proposed project, advising the applicant proposes to
<br />develop future industrial lots adjacent to his business, improve the dedicated por-
<br />tion of Lytle Creek Channel with concrete, and the development of dedicated streets.
<br />Mr. Trevino reported that area to the west will be down -zoned to R-3 which will serve
<br />as a buffer to adjacent properties. Mr. Trevino concluded the proposed project will
<br />create approximately $28,000 in taxes for the City, approximately 40 to 50 new jobs,
<br />and will develop this area to its highest and best use.
<br />Mayor Gonzales asked if anyone present desired to speak in favor of or in opposition
<br />to this matter.
<br />The following persons spoke in opposition to the proposed project, stating there was
<br />no need for another "junk yard" in South Colton, the business would create too much
<br />additional traffic along "M" Street and La Cadena Drive, the possible contamination
<br />of the City's drinking water supply by the uncontrolled dumping of vehicle fluids on
<br />the site and fire risk by storing and handling of lubricants and fuels, and the
<br />proposed business was not the "highest and best use" for the area.

<br />Mr. Ron Gemmel, representing the Colton Fire Department, referred to a committee that
<br />had studied possible locations for fire stations in Colton, advising that the property
<br />in question this evening was one of the sites selected as a good place for a fire
<br />station.
