large scope of the Plan, it is not known why this property was reclassified, <br />2 5 a reating a break in the General Commercial continuity along Washington Street. <br />Mr. Aguilera advised the Planning Commission has considered the entire frontage along <br />Washington Street as part of this request in order to better assess the situation. <br />The zoning from the intersection of Barton Road and Washington Street west along the <br />south side of Washington is C-2, and this same zoning continues westerly from the <br />property for approximately 1,000 feet. It is the Commission's opinion that the <br />General Plan was incorrect in interjecting a residential designation among viable <br />commercial uses and zones, therefore, it seems appropriate to reclassify the area <br />consistent with the surrounding classification of General Commercial. <br />Mr. Aguilera concluded if Council concurs, adoption of Resolution No. 4246 would be <br />in order. <br />Mayor Huntoon asked if anyone in the audience desired to speak on this matter. <br />Mr. John Olero spoke in support of the General Plan Amendment and zoning. <br />Moved by Councilman Rehrer, seconded by Councilwoman Garcia, to terminate the Public <br />Hearing. Unanimous vote. <br />Moved by Councilman Rehrer, seconded by Councilwoman Garcia, to approve RESOLUTION <br />NO. 4246. Unanimous vote. <br />General Plan <br />Housing Element <br />Mayor Huntoon declared the Public Hearing open. <br />City Clerk Ramos submitted the Affidavit of Publication and reported that no protests <br />or objections had been received. <br />Mr. Aguilera advised the California Planning law requires that all cities and counties <br />have an adopted Housing Element which conforms to the 1977 Housing Element Guidelines <br />or the new statutory requirements of Article 10.6, Section 65580, et seq., of the <br />Government Code. Statutory and case law have made it clear that local governments <br />in California may not legally approve rezonings, new subdivisions, or public works <br />projects in the absence of a complete and legally adequate General Plan. A General --. <br />Plan that lacks a Housing Element is not legally adequate. <br />Mr. Aguilera continued in order to conform to the requirements of State law, Staff <br />has prepared the attached Housing Element, and if approved by the City Council, the <br />Housing Element will be submitted for review and comments to the State Office of <br />Planning and Research. The State will then have 90 days to comment on our submit- <br />tal. Whether the State comments or not, the City can then adopt the Housing Element, <br />and it will be officially incorporated into Colton's General Plan. <br />Mr. Aguilera concluded if the Council concurs with the Planning Commission's recom- <br />mendation, a motion to instruct Staff to submit the City's Housing Element of the <br />General Plan to the State Office of Planning and Research. <br />Mayor Huntoon asked if anyone present desired to speak on this matter. <br />Councilwoman Garcia asked if this was reviewed by the Planning Commission. <br />Mr. Aguilera responded yes, it was. <br />Councilman Rios asked will this be subject to change by the State. <br />Mr. Aguilera said yes, the State may make changes which could or could not be <br />adopted by the City. Mr. Aguilera said we are not required to adopt the changes <br />recommended by the State. —_ <br />Councilman Rios asked if the City would be receiving any money from the State. <br />Mr. Aguilera answered no. <br />Moved by Councilman Rehrer, seconded by Councilman Rios, to terminate the Public <br />Hearing. Unanimous vote. <br />Moved by Councilman Rehrer, seconded by Councilman Rios, to approve and adopt Staff's <br />recommendation regarding the Housing Element of the General Plan.
