36a <br />Councilwoman Garcia asked if these items have been before the Plann- <br />ing Commission. <br />City Manager Elliott answered no, they will be heard by the Plann- <br />ing Commission next Tuesday. <br />Councilwoman Garcia said she would have difficulty dealing with a <br />matter like that, and questioned whether or not it was legal for <br />the City Council to set a matter for Public Hearing that has not <br />been considered by the Planning Commission as yet. Mrs. Garcia said <br />the Council has no recommendation from the Planning Commission to <br />follow, or no back-up material from Staff to refer to. <br />City Attorney Edward stated the matter of setting these items for Pub- <br />lic Hearing is routine, and at the actual Public Hearing, the Council <br />has the option of approving the matter, denying the matter, continuing <br />the hearing, or whatever they desire. <br />Councilwoman Garcia said she felt this was like putting the cart be- <br />fore the horse. <br />Councilman Rios asked if any of these properties have ever been be- <br />fore the Planning Commission before, possibly under another owner. <br />City Attorney Edwards answered yes, one of the parcels in question <br />has. <br />After discussion, moved by Councilwoman Cisneros, seconded by Council- <br />man Rios, to set for Public Hearing Zone Change requests, Index Nos. <br />A-3-83, A-4-83, and A-5-83, on Tuesday, August 16, 1983• Motion car- <br />ried, with Councilwoman Garcia voting N0. <br />CITY MANAGER'S REPORTS AND RECOMMENDATIONS: <br />City Manager Elliott stated he had no items for Closed Session, how- <br />ever, the Electric Utility Director, Gale Drews, has a presentation <br />to make. <br />Mr. Drews made a brief presentation regarding the electric utility <br />rate increase, advising that both Staff and the Utilities Commission <br />recommend the approved rate increase, per Resolution No. 4276, that <br />was to become effective upon Edison's implementation of their Step <br />II increase to the City, be deferred until the estimated fund balance <br />is expended. <br />Mr. Drews stated a number of different factors have contributed to <br />the estimated fund balance - purchases of power increasing and demand <br />decreasing when most of the utilities in the area are seeing reduc- <br />tions from 4% to 10%, system losses being reduced, and industrial <br />customers increasing production and expanding their facilities, and <br />a reduction in the peak demand of 2.69%. <br />Mr. Drews concluded our new computer system now has twelve months <br />of historical data available that will make rate studies easier and <br />more refined in the future and, along with this, Staff will intro- <br />duce a number of new computer programs. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rios, to ap- <br />prove Staff's recommendation with regard to deferring electric util- <br />ity rate increase. Unanimous vote. <br />CITY ATTORNEY'S REPORTS AND RECOMMENDATIONS: <br />PERS <br />'Ord. No. 1648 <br />City Attorney Edwards reported on the City election held Monday, <br />August 1, 1983, for the local miscellaneous and local fire em- <br />ployees, to amend the Contract between the City and PERS with re- <br />gard to payment of contributions for employees' retirement purposes. <br />AUG 1983 <br />
