380 <br />the citizens of the City of Colton and San Bernardino County. <br />Mr. Nat Alvarez thanked the Council saying, that Colton would always <br />be a special part of him because of the close working relationship <br />and the Bomberc Program. <br />CORRESPONDENCE: <br />Mayor Huntoon referred tc a letter dated September 14, 1983, from <br />Grayner/Rogers Engineering regarding proposed site on the Cooley <br />Ranch for a Kaiser Medical Facility. <br />Mr. Walter L. Siegl, Architect, HMC Architects Inc. addressed the <br />Council, saying he was present to appeal the decision of City <br />Engineer, Joe McGee, not to approve a grading plan for the Proposed <br />Kaiser-Permanente Medical Center at the Southwest Corner of Cooley <br />Drive and Via Venito. Mr. Siegl stated the site in question is <br />subject to inundation in a major storm from a potential overflow in <br />the San Timoteo Creek. Mr. Siegl reported Mr. McGee had advised them <br />by letter that in accordance with the requirements of Ordinance No. <br />1589, staff cannot grant a variance in a "AO" zone. <br />Mr. Siegl stated, in their opinion, they have met all conditions of <br />the city ordinance, based upon the following facts: <br />a. The finished floor elevation of the building has been <br />raised above 3' 8". This is above the gutter flowline <br />of the adjacent street and is considerably above the <br />projected flood hazard level. <br />b. If an overflow from the San Timotec Creek were to occur, <br />the presence of the tennis club immediately south of the <br />subject site will already cause a divided flow pattern; and <br />construction of the proposed building in approximately the <br />same orientation in an East-West direction will not have <br />significant impact on flows. <br />Mr. Siegl stated that it is his understanding, that the Council <br />can grant a variance, giving approval to the grading plan. <br />City Engineer McGee stated that Mr. Siegl's points made to the Mayor <br />and City Council are well made and he would not be opposed to such <br />a variance, however, he cannot give approval at Staff level. <br />Moved by Councilman Rios, seconded by Councilwoman Cisners, to approve <br />the variance request of Grayner-Rogers Engineering for Kaiser-Perma- <br />nente Medical Center. Motion carried. Councilwoman Garcia ABSTAINED. <br />City Attorney Edwards asked to address the Council. Mr. Edwards <br />stated the ordinance provides that a variance can be granted by the <br />Council on a showing of good cause, determining that there would be <br />hardships if the variance were not granted, and determing that the <br />variance would not result in increase flood heights. Mr. Edwards said <br />in order to make the record clear, may the record show that the <br />Council finds it to be true, the facts set forth in the engineering <br />letter in the Council packet, are in existence and that the require- <br />ments of the ordinance are found by the Council to exist. <br />City Attorney Edwards asked Councilman Rios if this was the intent c^ <br />his motion. <br />Councilman Rios responded, yes if that is what is required. <br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Assessments <br />Resolution No. 4374/79-1 <br />Mayor Huntoon advised that the matter of Assessment District 79-1, <br />would be continued to an Adjourned Council Meeting to be held Thursday <br />SEP _ 0 41933 <br />
