474 <br />City Attorney Edwards stated as reported by the City Clerk, more than <br />50 percent of the registered voters in the effected territory have <br />filed and not withdrawn valid written protests to the proposed annexa- <br />tion. In that circumstance, by State law, the City Council is requir- <br />ed to terminate the annexation proceedings and not annex the terri- <br />tory. <br />Mr. Edwards continued in order to complete the procedure, it is ap- <br />propriate at this time to declare the Public Hearing open, then to <br />terminate the Public Hearing, and that will complete the proceedings <br />for tonight. At the next Council Meeting, Staff will bring to the <br />Council a formal resolution, whereby the Council finds that the <br />requisite number of protests were filed, and the adoption of that <br />resolution will be the formal termination of the annexation proceed- <br />ings. <br />Mr. Edwards advised that if the matter remains as it is now, and there <br />is no change within the next few minutes, the annexation has been de- <br />feated by the written protests filed. <br />Mr. Edwards concluded as a matter of procedure, the Mayor should now <br />declare the Public Hearing open. <br />Mayor Huntoon declared the Public Hearing open. <br />City Attorney Edwards stated it would now he in order to close the <br />Public Hearing. <br />Moved by Councilman Rios, seconded by Councilman Rehrer, the Public <br />Hearing was terminated. Unanimous vote. <br />Moved by Councilman Rehrer, seconded by Councilman Rios, to continue <br />this matter to the next regular Council Meeting and instruct Staff to <br />prepare the appropriate resolution to bring before the City Council.. <br />Unanimous vote. <br />Prezoning <br />P. C. Res. No. 2009/Ord. No. 1664 <br />City Attorney Edwards stated this item, to consider the Prezoning of <br />the annexed area, should the area be annexed into the City, is now <br />academic, or moot, due to the previous action by the City Council on <br />the annexation, and therefore the Prezoning need not be considered. <br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Assessment District No. 79-1 <br />Mr. John Hutton, Principal Engineering Aide, Community Services, re- <br />ported on a letter from Berryman and Stephenson concerning the com- <br />pletion of Assessment District No. 79-1, Airport Commerce Center, ad- <br />vising that Riverside Construction Company has completed all contract <br />improvements with the exception of the drainage structure at the <br />Rialto Channel, which has been delayed because of a design change, and <br />Riverside Construction is requesting that the City Councilconsider <br />acceptance of all other street, sewer and water works as completed, <br />and withhold the acceptance of the drainage improvements which are now <br />in the process of being completed. <br />Mr. Hutton stated Staff has reviewed this request and feels that <br />Riverside Construction has performed in a faithful manner, and all <br />other reviewing agencies and utility companies have accepted all im- <br />provements as completed. <br />Mr. Hutton concluded Staff recommends that Council accept the mainte- <br />nance of Assessment District No. 79-1, Airport Commerce Center, with <br />the exception of the drainage facilities. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rehrer, to ap- <br />prove Staff's recommendation with regard to Assessment District No. <br />79-1.
