COMMUNITY DEVELOPMENT DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Mills Act Agreement <br />Community Development Director Aguilera advised the "Mills" Act, adopted <br />by legislation in 1976, and modeled after the "Williamson" Act provides <br />tax relief for owners of qualified historic properties who agree to <br />comply with certain preservation restrictions. To date, there has been <br />eight contracts signed in the State of California. The Historic and <br />and Scenic Preservation Commission reviewed a "Mills" contract for the <br />City and adopted the agreement attached, on January 9, 1991. <br />Director Aguilera stated the "Mills" Act would provide an incentive <br />to owners of historically eligible property and designated landmarks <br />within the City to preserve the character identity of the same. There <br />will be no financial impact to the City, since the tax reductions <br />will be applied to property taxes levied by the County. Director <br />Aguilera recommended the adoption of the "Mills" Act agreement. <br />Moved by Councilman Gonzales, seconded by Councilwoman Cisneros to <br />approve the use of the "Mills" Act Agreement in the City. Unanimous <br />vote. <br />File Index DT-64-90/Wvatt Const. <br />Community Development Director Aguilera reported Mr. Wyatt has <br />submitted a request which indicates that he is requesting clarification <br />as to the Council's action regarding Tentative Tract 15101. Director <br />Aguilera stated on December 18, 1990 the Council voted to deny the plan, <br />however, it was unclear if the Council also wished to allow Mr. Wyatt <br />to amend the plan for reconsideration. Mr. Aguilera outlined two <br />alternatives: <br />1. If the intent was to allow Mr. Wyatt to resubmit the plans <br />with amendments, then Mr. Wyatt could do so without once again <br />paying all pertinent fees, amounting to approximately $1,110. <br />2. If the intent was to deny Tentative Tract 15102 with no other <br />stipulation, then Mr. Wyatt will have to pay all fees again, <br />if he wishes reconsideration. <br />Director Aguilera stated the Council has the ability to interpret their <br />decision in favor of either alternative one or two. Staff believes <br />that the project could answer the concerns of the opposing residents <br />with some modifications, if it was allowed to be resubmitted. <br />Moved by Councilman Roman, seconded by Councilman Lofy, to approve <br />Alternative #1.
