Mayor Gonzales opened the floor for discussion on the Urban Water <br />Management Plan for the City of Colton. <br />Moved by Council Member Cisneros, seconded by Council Member Lofy <br />to close the Public Hearing. Unanimous vote. <br />Moved by Council Member Lofy, seconded by Council Member Rehrer to <br />approve staff's recommendation. Unanimous vote. <br />RESOLUTION NO. R-35-91 - RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON ADOPTING THE CITY'S URBAN <br />WATER MANAGEMENT PLAN FOR 1990-1995. <br />Amendment to O -19A-89 <br />Mayor Gonzales declared the Public Hearing open. <br />City Clerk Ramos submitted the Affidavit of Publication and reported <br />that no protests or objections had been received. <br />Community Development Director Aguilera reported that Ordinance <br />No. O -19A-19 as approved by the voters of Colton in 1990 has several <br />difficiences which can be grouped into several categories: 1) legal <br />issues 2) enforcement by staff; 3) enforcement by the Commission; <br />4) ambiguities; 5) contradictions and 6) inability of the Ordinance <br />to carry out its purpose of protecting mobile home owners from <br />exorbitant rent increases. The alternatives have been thoroughly <br />dicusssed with legal staff represented by Amy York and Julie Biggs <br />of Best, Best & Krieger and the Mobile Home Rent Review Commission. <br />The changes will not adversely affect mobile home owners or mobile park <br />owners. Impact to the City is negligible since all operating costs <br />are paid for by the registration fees. Mr. Frederickson, Mobile <br />Home Rent Review Commissioner is available for any questions. <br />Mr. Aguilera stated it is the recommendation of staff and the Rent <br />Stabilization Commission to waive full reading and adoption of first <br />reading of ORDINANCE NO. 0-6-91. <br />Mayor Gonzales opened the floor for discussion amending Ordinance <br />No. 0-19A-89. <br />Council Member Lofy questioned whether adverse reaction was expressed <br />by the Rent Stabilization Commission. <br />Mr. Aguilera responded there were two areas of disagreement between <br />the legal staff and the commissioners; these areas are in relation <br />to policy and not legal restriction. The areas of disagreement are <br />in the change in percentages for profit guarantee and the number <br />of signatures on the petition for request of a change. <br />Mr. Fredrickson responded on behalf of the Rent Stabilization <br />Commissioners and addressed the areas of differences. <br />William Kalogonis, 700 East Washington #241, spokesperson for <br />4 M M 1 1991' <br />
